WHEREAS, the City of Newark is in need of suppliers to provide bulk water purification chemicals necessary to treat the water at the Pequannock Water Treatment Plant for the operation of the City of Newark's water utility system; and
 
WHEREAS, pursuant to the public bidding process of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., the Department of Water and Sewer Utilities advertised on April 23, 2013, in a general circulation newspaper, for the receipt of sealed bids for Water Purification Chemicals for the Pequannock Water Treatment Plant, West Milford, New Jersey; and
 
WHEREAS, fifteen (15) prospective bidders requested Bid Specifications from the Department of Water and Sewer Utilities; and
 
WHEREAS, on May 8, 2013, the Department of Water and Sewer Utilities received sealed bids from eleven (11) contractors for the supply of the following chemicals for water treatment at the Pequannock Water Treatment Plant:
 
Mixture of Aluminum Sulfate and Polyquatenary Amine in Water (Clar+Ion A505P or Delfloc 611)
Poly-aluminum Hydroxychloro-Sulfate (Poly-aluminum Chloride)
Sodium Silicate Solution (N Sodium Silicate)
Calcium Oxide (Quick Lime)
Chlorine (Liquid) - 1-ton cylinders
Cationic Polymer 573 (Superfloc C573)
Anionic Polymer 1883 (Superfloc A1883); and
 
WHEREAS, the bid submitted by Jacksson Chemical LLC, P.O. Box 606, Livingston, New Jersey 07039, to supply Anionic Polymer (Superfloc A1883) @ $1.39.lb was rejected by the City of Newark due to failure to include a bid bond required by the bid specification, which is a material condition of the bid that cannot be waived; and
 
 
WHEREAS, upon review of the bids submitted, the Department of Water and Sewer Utilities, has determined that the following contractors submitted the lowest responsible bids in compliance with the Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.:
 
General Chemical Performance Products, LLC, 90 East Halsey Road, Parsippany, New Jersey 07054, to supply Mixture of Aluminum Sulphate and Polyquatenary Amine in Water (Clar+Ion A505P) @ $0.138/lb;
 
USALCO Baltimore Plant, LLC, 2601 Cannery Avenue, Baltimore, Maryland 21226, to supply Poly-aluminum Chloride @ $0.1763/lb;
 
Brenntag Northeast Inc., 81 W. Huller Lane, Reading, Pennsylvania 19605, to supply Sodium Silicate Solution (N Sodium Silicate) @ $0.1698/lb;
 
Carmeuse Lime Inc., 11 Stanwix Street, 21st Floor, Pittsburgh, Pennsylvania 15222, to supply Calcium Oxide (Quick Lime) @ $0.090645/lb;

WHEREAS, the bids were reviewed by the Department of Water and Sewer Utilities and found that the objectives of competitive bidding were achieved, that favorable bid prices were received, and that General Chemical Performance Products, LLC, USALCO Baltimore Plant, LLC, Brenntag Northeast Inc., Carmeuse Lime, Inc., JCI Jones Chemicals Inc., and George S. Coyne Chemical Co Inc., are responsible contractors capable of providing the products in accordance with the bid specifications; and
 
WHEREAS, based on the above findings, the City of Newark has determined that in accordance with N.J.S.A. 40A:11-1 et seq., the above listed contractors constitute the lowest and responsible bidders for each of the products; and
 
WHEREAS, the City of Newark desires to award a contract to each of the aforementioned vendors in the amounts specified in the Bids for the supply of chemicals for water treatment at the Pequannock Water Treatment Plant, for the period from June 1, 2013 to May 31, 2014; and
 
 
WHEREAS, the award of this contract is necessary for the efficient operation of the City of Newark Pequannock Water Treatment Plant and is in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq. and is in compliance with the fair and open process described in the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.5, et seq.
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
 
1.       The Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities is hereby authorized to enter into contracts with the following suppliers for a term of one (1) year, commencing on June 1, 2013 and terminating on May 31, 2014, as follows:
 
      General Chemical Performance Products, LLC, 90 East Halsey Road, Parsippany, New Jersey 07054, to supply Mixture of Aluminum Sulphate and Polyquatenary Amine in Water (Clar+Ion A505P) @ $0.138/lb in an amount not to exceed $160,000.00
 
USALCO Baltimore Plant, LLC, 2601 Cannery Avenue, Baltimore, Maryland 21226, to supply Poly-aluminum Chloride @ $0.1763/lb in an amount not to exceed $65,000.00;
 
Brenntag Northeast Inc., 81 W. Huller Lane, Reading, Pennsylvania 19605, to supply Sodium Silicate Solution (N Sodium Silicate) @ $0.1698/lb in an amount not to exceed $150,000.00;
 
Carmeuse Lime Inc., 11 Stanwix Street, 21st Floor, Pittsburgh, Pennsylvania 15222, to supply Calcium Oxide (Quick Lime) @ $0.090645/lb in an amount not to exceed $65,000.00;
 
JCI Jones Chemicals Inc., 103 River Street, Warwick, New York 10990, to supply Chlorine (Liquid) - 1 ton cylinders @ $0.151/lb in an amount not to exceed $60,000.00;
 
George S. Coyne Chemical Co Inc., 3015 State Road, Croydon, Pennsylvania 19021, to supply Cationic Polymer (Superfloc C573) @ $0.7559/lb in an amount not to exceed $65,000.00; and
 
George S. Coyne Chemical Co. Inc., 301 State Road, Croydon, Pennsylvania 19021, to supply Anionic Polymer (Superfloc A1883) @ $1.561/lb in an amount not to exceed $25,000.00;
 
for the purpose of supplying chemicals to treat the water at the Pequannock Water Treatment Plant, in accordance with the Bid Specifications.
 
3.       There shall be no amendment or change to the contracts without approval by the Newark Municipal Council approval.
 
4.       There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
 
5.       The Acting Director of the Department of Water and Sewer Utilities shall forthwith file duly executed copies of the contracts in the Office of the City Clerk.
 
6.      The Department of Water and Sewer Utilities has determined that funds will be available and will be allocated in the 2013 Budget of the Department of Water and Sewer Utilities and included in a line item for the award of this contract and this contract shall be subject to that appropriation.  There will be no expenditure of funds authorized until a certification of funds is obtained and a copy filed with the City Clerk.
 
 
7.       If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
 
 
STATEMENT
 
This resolution authorizes the Mayor and/or his designee, the Acting Director of the Department of Water and Sewer Utilities to enter into contracts with General Chemical Performance Products, LLC, USALCO Baltimore Plant, LLC, Brenntag Northeast Inc., Carmeuse Lime, Inc., JCI Jones Chemicals Inc., and  George S. Coyne Chemical Co Inc., for the purpose of supplying chemicals to treat the water at the Pequannock Water Treatment Plant, for the period from June 1, 2013 to May 31, 2014.
