      WHEREAS, pursuant to Resolution 7R1-C adopted September 18, 2013, the Municipal Council of the City of Newark authorized the Mayor and/or his designee, the Business Administrator, to enter into and execute an agreement with Jewish Renaissance Medical Center, Inc. (hereinafter referred to as "Sub-recipient"), to provide certain Urban Agriculture/Tree Planting Services, in the amount of $12,273.00, for the period of January 1, 2013, through December 31, 2013 (a copy of said Resolution is attached hereto and made a part hereof); and
 
WHEREAS, an agreement with Sub-recipient as described above was, in fact, thereafter executed (a copy of which is attached hereto and made a part hereof, and which shall hereinafter be referred to as the "Agreement"); and
 
WHEREAS, the Sub-recipient provided the contracted Health Services in an effective and efficient manner during the initial term of the Agreement; and
 
WHEREAS, due to the importance of the services and programs funded in whole or in part by CDBG funds awarded to the City of Newark and performed or operated by local sub-recipients for the benefit of the public, as well as the importance of utilizing HUD funding in a timely manner, the Mayor and Business Administrator believe it is in the best interest of the City of Newark and the public, who benefit from the services and programs, to extend the Agreement between Sub-recipient and the City of Newark, for an additional year, i.e., until December 31, 2014, at no additional cost to the City of Newark; and
 
WHEREAS, the Mayor and/or his designee, the Business Administrator, desire to amend the terms of the existing Agreement between the City of Newark and the Sub-recipient by extending the contract term through December 31, 2014, so that the Sub-recipient continues to provide services of the same nature and type, at no additional cost to the City of Newark; and
 
WHEREAS, the Agreement is being amended in compliance with Community Development Block Grant Regulations, 24 CFR.570.201.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Business Administrator, are hereby authorized to enter into and execute an Amendment Agreement on behalf of the City of Newark with Jewish Renaissance Medical Center, Inc., 275 Hobart Street, Perth Amboy, New Jersey 08861, to provide Health Services, which are further described in the "Scope of Services" attached hereto and made a part hereof, for the amended agreement term of January 1, 2012 through December 31, 2014, at no additional cost to the City of Newark.
 
2.      The Amendment Agreement between the City of Newark and the Sub-recipient is hereby ratified from January 1, 2014, to the date of adoption of this authorizing resolution.
 
3.      All other terms and conditions of the original Agreement with Sub-recipient shall remain unchanged and in full force and effect.
 
4.      This contract is being awarded pursuant to the Community Development Block Grant Regulations, 24 CFR.570.201 regulations, and is in compliance with State Pay-to-Play Law, N.J.S.A. 19:44A-20.5 and Newark Executive Order ME0-07-0001, effective March 31, 2007.
 
5.      A fully executed copy of said Amendment Agreement shall be filed with the Office of the City Clerk by the Business Administrator.
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Assistant Business Administrator, to enter into and execute an Amendment Agreement with Jewish Renaissance Medical Center, Inc., 275 Hobart Street, Perth Amboy, New Jersey 08861, to provide Health Services for the amended agreement term of January 1, 2013 through December 31, 2014, at no additional cost to the City of Newark.
