WHEREAS, Resolution 7R12-a, adopted September 2, 2015 authorized the award to Investigate Sources of Extraneous Flow to the City of Newark Combined Sewer System to Arcadis US, Inc., 17-17 Route 208 North, Fair Lawn, New Jersey 07410, in the amount not to exceed $125,000.00 in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and
WHEREAS, the original contract term was for three hundred sixty five (365) days from the effective date of the issuance of the Notice to Proceed, from October 29, 2015 to October 29, 2016; and
WHEREAS, as a result of the following unforeseen delays due to unanticipated findings and field conditions, an extension of time is required (“First Extension”) in order to complete successfully the Investigation Sources of Extraneous Flow to the City of Newark Combined Sewer System; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Change Order #1 to Investigate Sources of Extraneous Flow to the City of Newark Combined Sewer System with Arcadis U.S., Inc. The Director of the Department of Water and Sewer Utilities requests an extension of the contract term for an additional year, from October 29, 2016 to October 29, 2017 in order for Arcadis U.S., Inc. to successfully complete the professional services contract as permitted by the Local Public Contracts Law, N.J.S.A. 40A:11-15 (9), subject to Municipal Council approval.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, is hereby authorized, on behalf of the City of Newark, to issue Change Order No. 1 for a one (1) year extension of the term of the contract to Investigate Sources of Extraneous Flow to the City of Newark Combined Sewer System from October 29, 2016 to October 29, 2017, at no additional cost to the City of Newark.
2. The Municipal Council hereby ratifies the contract extension from October 29, 2016 to the date of adoption of this authorizing resolution.
3. A fully executed copy of Change Order No. 1/Contract Amendment shall be filed in the Office of the City Clerk by the Director of the Department of Water and Sewer Utilities.
4. No other changes to this contract are allowed without prior Municipal Council approval.
5. Any further extensions, as may be permitted by N.J.S.A. 40A:11-15 (9), are subject to Municipal Council approval.
6. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller no later than twenty (20) days following such award, in accordance with N.J.S.A. 52:15C-10 and the notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to amend its Professional Services Contract (Resolution # 7R12-a 090215) to Investigate Sources of Extraneous Flow to the City of Newark Combined Sewer System with Arcadis U.S., Inc. 17-17 Route 208 North, Fair Lawn, New Jersey 07410 by executing Change Order No. 1, for one (1) year extension to the contract term, from October 29, 2016 to October 29, 2017 for no additional cost to the City.
