WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) State Aid to Counties and Municipalities FY2022 Municipal Aid Program (“NJDOT Municipal Aid Program”) provides grant funding for the improvement and construction of local, municipal, and county road and bridge projects; and
WHEREAS, the City of Newark has a need for this funding so that it may improve various roads that include drainage, ADA ramps, resurfacing, decorative crosswalks and pavement markings throughout the City of Newark; and
WHEREAS, the City of Newark desires to further the public interest by obtaining funding from the NJDOT Municipal Aid Program for Newark - 20 Paving Locations for MA-2022 within the City of Newark; and
WHEREAS, on July 1, 2021, on behalf of the City of Newark, the Director of the Department of Engineering submitted an application to the NJDOT requesting grant funding in the amount of $3,896,666.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Newark - 20 Paving Locations for MA-2022 within the City of Newark, identified as application MA-2022-Newark - 20 Paving Locations for City of Newark with no municipal funds required; and
WHEREAS, pursuant to the terms of the grant application, a copy of which is attached hereto, the City of Newark is required to submit a resolution from the Newark Municipal Council authorizing submission of the grant application; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering desires to accept the grant award and execute a grant agreement governing said award; and
WHEREAS, upon notification of the receipt of a grant award in connection with this application MA-2022 - Newark - 20 Paving Locations for City of Newark, the Director of the Department of Engineering shall submit a copy of the grant agreement to the City Clerk, Corporation Counsel and the Business Administrator for review, approval and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council formally approves the grant application for the above-stated project.
2. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit an electronic grant application, identified as MA-2022 - Newark - 20 Paving Locations to the New Jersey Department of Transportation, on behalf of the City of Newark, requesting grant funding in the amount of $3,896,666.00 from the NJDOT Municipal Aid Program for Street Resurfacing - Newark - 20 Paving Locations for MA-22, within the City of Newark with no municipal funds required (a copy of the application is attached hereto and made a part hereof).
3. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
4. Upon notification of the receipt of a grant award in connection with this application, the grant is hereby accepted in the amount applied for and/or any increase or decrease thereto.
5. Upon notification of the receipt of a grant award in connection with this application, the Mayor and/or his designees, the Director of the Department of Engineering and the City Clerk, are hereby authorized to enter into and execute grant documents with the NJDOT to receive and expend the grant award for Street Resurfacing - Newark - 20 Paving Locations for MA-22 within the City of Newark.
6. Upon notification of the receipt of a grant award in connection with this application, the Director of the Department of Engineering shall submit a complete copy of the grant agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
7. No municipal funds are required for receipt or acceptance of this grant award.
8. The Director of the Department of Engineering shall file a fully-executed copy of the grant application, grant award letter, and the grant agreement in the Office of the City Clerk.
STATEMENT
This Resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering to submit an electronic grant application for, accept, and enter into and execute an agreement for grant funding in the amount of $3,896,666.00 from the New Jersey Department of Transportation Municipal Aid Program for Street Resurfacing - Newark - 20 Paving Locations for MA-22 within the City of Newark, with no municipal funds required.
