WHEREAS, the Municipal Council of the City of Newark adopted an Urban Renewal Plan for the Old Third Ward Urban Renewal Project (the “Redevelopment Plan”) by Resolution 7Rb on June 15, 1960; and
WHEREAS, the Municipal Council has amended the Redevelopment Plan on multiple occasions, most recently by adopting the 20th Amendment to the Redevelopment Plan in 2011 to revise the Plan’s Land Use Map and its text to ensure that context appropriate development would occur in the area’s remaining developable sites; and
WHEREAS, a 21st Amendment to the Redevelopment Plan has been prepared by the City’s Planning Division which, if adopted, will permit modern development patterns in the plan area and will contain context appropriate density, use and design for undeveloped and underdeveloped parcels in the plan area; and
WHEREAS, the City’s Director of Planning provided the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) to the Central Planning Board for their review and consideration, pursuant to N.J.S.A. 40A:12A-7e; and
WHEREAS, on June 26, 2017 the Central Planning Board conducted a hearing on the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6), pursuant to N.J.S.A. 40A:12A-7e and adopted a Resolution which recommends that the Municipal Council adopt the proposed 21st Amendment as drafted; and
WHEREAS, the Municipal Council has determined that it is in the best interest of the public to accept the recommendation of the Central Planning Board to adopt the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6), in the form attached hereto.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
Section 1. The Municipal Council hereby finds and determines that the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) generally conforms to the City’s Master Plan and that the adoption of the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) is necessary for better development and design so that the City of Newark maintains its preeminent position in the region and to permit vacant, deteriorated, underutilized, or obsolete property to return to full productivity by creating new appropriate development opportunities within this area in need of redevelopment.
Section 2. The Municipal Council hereby adopts the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6). To the extent that this 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) is inconsistent with the original Urban Renewal Plan for the Old Third Ward Urban Renewal Project and its previous amendments thereto, this 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) shall supersede all previous zoning standards and development regulations for the redevelopment area set forth therein.
Section 3. The Municipal Council hereby amends the zoning district map of the City of Newark to reflect the revisions made to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6). The amended zoning district map is within the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6).
Section 4. The City Clerk shall keep on file a copy of the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) and the June 26, 2017 Resolution from the Planning Board.
Section 5. The Municipal Council hereby ratifies the referral of the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Renewal Project (NJR-6) to the Central Planning Board, pursuant to N.J.S.A. 40A:12A-7e, forty-five (45) days prior to the date of the Planning Board hearing until the date of adoption of this authorizing Ordinance.
Section 6. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
This Ordinance adopts the 21st Amendment to the Urban Renewal Plan for the Old Third Ward Urban Renewal Project (NJR-6) and ratifies the referral of said 21st Amended Plan to the Central Planning Board, pursuant to N.J.S.A. 40A:12A-7e, forty-five (45) days prior to the date of the Planning Board hearing until the date of adoption of this authorizing Ordinance.
