           WHEREAS,  on August 7, 2013 through Resolution 7R3-L , the Municipal Council of the City of Newark authorized the Mayor to accept the following Youth Workforce Investment Act grant funds pursuant to the Workforce Investment Act of 1998, PL 105-220, August 7, 1998 (hereinafter referred to as "WIA"); in the amount of $2,055,012.00; and
 
      WHEREAS, there exists a need for NewarkWORKS to enter into contract with an entity that can provide educational services to thirty (30) clients in the areas of "Academic Enrichment" training pursuant to the provisions of the WIA for the 2013-2014 Program Year (July 1, 2013 through June 30, 2014); and
 
      WHEREAS, on September 13, 2013 NewarkWORKS advertised a Request for Proposal, returnable on October 8, 2013 for the above-referenced educational and training services under the provisions of the WIA for the 2013-2014 Program Year, a copy of the Request for Proposal is attached hereto and made part thereof; and
 
WHEREAS, on October 8, 2013, NewarkWORKS received proposals from twelve (12) entities, which were opened on the same day and entered on the bid tabulation sheet, a copy of which is attached hereto; and        
 
WHEREAS,  the proposal received from Children's Hospital of New Jersey at NBIMC, 201 Lyons Avenue, Newark, New Jersey  07112 was reviewed by a selection committee of the Newark Youth Investment Council and was found to be most advantageous to the City of Newark based upon price, experience and all other criteria listed in the Request for Proposal; and
 
WHEREAS, NewarkWORKS wishes to enter into a one (1) year contract with Children's Hospital of New Jersey at NBIMC to provide the above-referenced "Academic Enrichment" training pursuant to the WIA for thirty (30) clients in an amount not to exceed $122,820.00 for Program Year 2013-2014, all funds from Program 2013-2014 must be fully expended no later than June 30, 2015; and
 
WHEREAS, the Municipal Council of the City of Newark wishes to authorize and ratify the use of competitive contracting for processing these WIA Youth Programs from September 13, 2013 to the date of adoption of this resolution and authorizes its use in the future; and
 
WHEREAS, this contract is being awarded pursuant to State Local Public Contracts Law, including N.J.S.A. 40A:11-4.1(b) (2) and/or N.J.S.A. 40A:11.5 and/or as educational services to N.J.S.A. 40A:11-5(1) (q) (as applicable), and the WIA; and
 
WHEREAS, this contract is being awarded pursuant to the Fair and Open Procedures of the State Pay-to-Play Law (N.J.S.A. 19:44A-20.5); and
 
WHEREAS,  the Mayor of the City of  Newark signed into law Executive Order Number MEO-07-0001 ("Pay-to-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:     
 
1.      The Mayor and/or his designee(s), the Deputy Mayor/Director of Economic and Housing Development and Deputy Director of Newark One Stop Career Center/NewarkWORKS are hereby authorized to enter into and execute a contract with Children's Hospital of New Jersey at NBIMC, 201 Lyons Avenue, Newark, New Jersey 07112 to provide training to thirty (30) clients in the areas of "Academic Enrichment" training and follow-up services under WIA Youth for Program Year 2013-2014 for an amount not to exceed $122,820.00. The term of the contract will be established for a one (1) year period (July 1, 2013-June 30, 2014).
 
2.      The Municipal Council of the City of Newark hereby authorizes and ratifies the use of competitive contracting for processing and awarding these WIA Youth Programs from September 13, 2013 to the date of adoption of this authorizing resolution and authorizes its use in the future.
 
3.      This contract between the City of Newark and Children's Hospital of New Jersey at NBIMC is hereby ratified from July 1, 2013 to the date of adoption of this authorizing resolution.
 
4.      The contract is subject to availability of funds from the United States Department of Labor, Employment and Training Administration, Workforce Investment Act of 1998 through the New Jersey Department of Labor and Workforce Development.
 
5.       Attached hereto is a Certification of Funds from the Municipal Comptroller of the City of Newark, which states: (1) that there are sufficient funds available, in the amount of $112,820.00 for purpose set forth hereinabove; and (2) that the line appropriation of the Official Budget, which shall be charged is Business Unit NW051, Department ID G13, Div/Proj. 3M310, Activity A, Account #72060, Budget Reference B2013.
 
6.      There shall be no advance payment on this contract in accordance with N.J.S.A.40A:5-16.
 
7.      There shall be no amendment or changes to this contract without approval of the Municipal Council of the City of Newark.
 
8.      The Deputy Director of Newark One Stop Career Center/NewarkWORKS shall file a fully executed copy of the contract in the Office of the City Clerk and shall be made available for public inspection.
 
9.      This contract is being awarded to a non-profit organization and as such is not governed by the State-Pay-to-Play Law, N.J.S.A. 19:44A-20-5, or Newark Executive Order on Pay-to-Play Reform, MEO-07-0001.
 
 
STATEMENT:
 
This resolution hereby ratifies and authorizes the Mayor, and/or his designee(s), the Deputy Mayor/ Director of the Department  of Economic and Housing Development and the Deputy Director of Newark One Stop Career Center/NewarkWORKS to enter into and execute a contract with Children's Hospital of New Jersey at NBIMC, 20l Lyons Avenue,  Newark, New Jersey  07112 pursuant to the provisions of WIA, to provide services in the areas of "Academic Enrichment" training to thirty (30) clients for a total not to exceed $122,820.00 for a one (1) year term Program Year 2013-2014 (July 1, 2013 through June 30, 2014), grant funds must be fully expended, no later than June 30, 2015.
