         WHEREAS, R.G.O. 23:4-2 establishes the hours and regulations of the Exclusive Bus Lanes along Broad Street; and
 
          WHEREAS, R.G.O. 23:4-3 establishes the hours and regulations of the Exclusive Bus Lanes along Market Street; and
 
          WHEREAS, the Exclusive Bus Lanes have operated effectively since October 17, 1988; and
 
WHEREAS, a Memorandum of Understanding was established on December 18, 1990 between the City of Newark and New Jersey Transit whereby New Jersey Transit would grant funds to the City of Newark to ensure the enforcement of the Exclusive Bus Lane Ordinance; and
   
              WHEREAS, an Agreement Modification (attached to this Resolution) was signed between the City of Newark Police Department and New Jersey Transit in 2002 which established an annualized payment of $235,597.44 to be utilized towards Exclusive Bus Lane Ordinance enforcement operations; and
 
WHEREAS, an Agreement Modification (attached to this Resolution) was signed between the City of Newark Police Department and New Jersey Transit on December 12, 2011 to extend the 2002 Memorandum of Understanding through December 31, 2012; and
 
WHEREAS, the Memorandum of Understanding and Agreement Modification established that New Jersey Transit will continue to grant funds to the City of Newark for the enforcement of R.O. 23:4-2 et seq., in a quarterly amount of $58,899.36 for an annualized total of $235,597.44, for the period January 1, 2012 through December 31, 2012.   
 
 
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
 
1.      The Mayor and/or his designee, the Director of Police, are hereby authorized and directed to execute the Agreement Modification with New Jersey Transit.
 
2.      The acceptance of the Agreement Modification is ratified from December 12, 2011 to the date of adoption.
 
3.      The City of Newark hereby accepts funding from New Jersey Transit in a quarterly amount of $58,899.36 for an annualized total of $235,597.44, for the period of January 1, 2012 through December 31, 2012.
 
4.      All other terms and conditions of the original MOU remain the same and the Police Director remains responsible for enforcement and reporting.   
 
5.      A duly executed copy of the Agreement Modification between the City of Newark and New Jersey Transit shall be filed in the Office of the City Clerk and to be attached to the original Memorandum of Understanding by the Police Director.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Police Director, to enter into an Agreement Modification and accept funds in quarterly amount of $58,899.36 from New Jersey Transit in order to enforce the Exclusive Bus Lanes Program from January 1, 2012 to December 31, 2012.
