WHEREAS, on May 15, 2026, the City of Newark, through its Purchasing Agent, QPA, advertised for bids from contractors to provide surveillance and protection of the interior and exterior of authorized City locations (Armed Security Guards) for the Department of Public Safety, Division of Police, as described in the attached bid proposal; and
WHEREAS, the Division of Central Purchasing also published the bid package on the City of Newark's website to provide broader access and download capability to potential bidders; and
WHEREAS, sixty-three (63) prospective bidders downloaded the bid package; and
WHEREAS, on June 3, 2026, eight (8) bids were received in response to this advertisement, including one (1) "No Bid" submission; and
WHEREAS, upon review and evaluation of all bids received, the Department of Public Safety, Division of Police, recommended that a single award be made to Custom Protective Services, 275 Madison Avenue, Suite 1601, New York, New York 10016, as the lowest responsive and responsible bidder; and
WHEREAS, the Purchasing Agent concurs with the recommendation from both departments that a single award be made to Custom Protective Services; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24, the recommended bidder consented to holding its bid prices for consideration until such time as an award is made, as permitted by law; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq. meet the requirements of the Fair and Open process;
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark, and/or his designee, the Business Administrator, and the Purchasing Agent are hereby authorized to enter into and execute a contract with Custom Protective Services, 275 Madison Avenue, Suite 1601, New York, New York 10016, to provide surveillance and protection of the interior and exterior of authorized City locations (Armed Security Guards) for the City's Department of Public Safety, Division of Police. The bid was received on the advertised due date and determined to be the lowest responsive and responsible bid in accordance with the bid specifications. The term of the contract shall be for twelve (12) months upon execution and may be extended for up to two (2) additional one-year terms upon written agreement of both parties, pursuant to N.J.S.A. 40A:11-15, commencing upon contract execution, at a cost not to exceed Six Million Sixty-Three Thousand Five Hundred Ninety-Five Dollars and Zero Cents ($6,063,595.00) per year.
2. There shall be no amendment or change to this Resolution without the approval of the Municipal Council.
3. There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.
4. This is an open-ended contract to be used as needed during its term. For any expenditures against it, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from the following account codes: 2026 Budget / Department of Public Safety, Division of Police Funding Source: NW011-200-2001-71630-B2026. Funds for 2027 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2). This contract shall not exceed Six Million Sixty-Three Thousand Five Hundred Ninety-Five Dollars and Zero Cents ($6,063,595.00) per year.
5. The Purchasing Agent, QPA, shall file a duly executed copy of the contract in the Office of the City Clerk, if applicable.
6. If required by State law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated July 1, 2025.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark, and/or his designee, the Business Administrator, and the Qualified Purchasing Agent to enter into and execute a contract with Custom Protective Services, 275 Madison Avenue, Suite 1601, New York, New York 10016, to provide surveillance and protection of the interior and exterior of authorized City locations (Armed Security Guards) for the City's Department of Public Safety, Division of Police, at a cost not to exceed ($6,063,595.00) per year, for a period of twelve (12) months, commencing upon execution and may be extended for up to two (2) additional one-year terms upon written agreement of both parties.
