WHEREAS, on February 8, 2021 and April 16, 2021, the City of Newark through its Purchasing Agent, QPA (the “City”), advertised to solicit proposals for contractors to provide Non-Congregate Emergency Shelter Operations Management for the Department of Health and Community Wellness, as described in the attached Request for Proposal; and

 

WHEREAS, the Division of Central Purchasing also distributed fourteen (14) Request for Proposal (RFP) packages to prospective vendors following the date of advertisement; and

 

WHEREAS, the Division of Central Purchasing also published the Request for Proposal (RFP) package on the City of Newark’s website to provide broader access and download capability to potential respondents; and

 

WHEREAS, on May 6, 2021 the Division of Central Purchasing received one (1) proposal in response to the April 16, 2021 advertisement; and

 

WHEREAS, the proposal received from The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102, was most advantageous to the City of Newark based on experience and criteria listed on the Request for Proposal; and

 

WHEREAS, the Evaluation Committee recommended that an award be made to The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102, in the best interest of the City, price and other factors considered; and

 

WHEREAS, the Purchasing Agent, QPA, concurs with the recommendation from the Evaluation Committee that a single award be made to The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102; and

 

WHEREAS, the contract will be ratified to begin on May 15, 2021, the date of the QPA report; and

 

WHEREAS, pursuant to State Local Public Contracts Law N.J.S.A. 40A:11-4.1 (b)(3) competitive contracting process may be used for the operation, management or administration of social service facilities or programs; and

 

WHEREAS, the City wishes to enter into a contract with The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102, to provide Non-Congregate Emergency Shelter Operations Management; and

 

WHEREAS, the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor of the City of Newark and/or his designee, the Business Administrator and/or the Director of the Department of Health and Community Wellness, are hereby authorized to enter into and execute a contract with The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102, to provide Non-Congregate Emergency Shelter Operations Management for the City’s Department of Health and Community Wellness, whose proposal was received on the advertised due date and determined to be in the best interests of the City, price and other factors considered. The term of the contract will be established for a period not to exceed twelve (12) consecutive months, with the City retaining an option to renew for an additional twelve (12) months.

 

2.                     There shall be no amendment or change of this contract without the approval of the Municipal Council.

 

3.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16. Funds for 2019 and subsequent years are contingent upon appropriations, pursuant to N.J.A.C. 5:30-5.5(d)(2).

 

4.                     This is an open-ended contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed before a contractual liability is incurred each time an order is placed from Account Code Line: NW51-2H211-72030-B2020. This contract shall not exceed One Million One Hundred Ninety-Eight Thousand Four Hundred Thirty Dollars and Zero Cents ($1,198,430.00) and not exceed twelve (12) consecutive months for one (1) vendor.

 

5.                     This contract is being awarded pursuant to the competitive contracting process under N.J.S.A. 40A:11-4.1(b)(3). 

 

6.                     The Purchasing Agent, QPA, shall file a duly executed copy of this contract in the Office of the City Clerk.

 

7.                     If required by State Law, the City Clerk shall provide the appropriate Notice of Award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.

The resolution ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Business Administrator and/or the Director of the Department of Health and Community Wellness, to enter into and execute a contract with The Salvation Army, 45 Central Avenue, Newark, New Jersey 07102, to provide Non-Congregate Emergency Shelter Operations Management to the City’s Department of Health and Community Wellness, at a cost not to exceed $1,198,430.0) and for a period not to exceed twelve (12) consecutive months, with the City retaining an option to renew for an additional twelve (12) months.
