WHEREAS, pursuant to Resolution 7R1-C, authorized on October 05, 2011 the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute an agreement (“Sub-recipient Agreement”) with Clinton Hill Community and Early Childhood Center, Inc. (“Sub-recipient”) to provide physical rehabilitation to its facility located at 420 Hawthorne Avenue, Newark, New Jersey  07112 (the “Project”), in the amount of $71,600.00, for the term of January 1, 2011 through December 31, 2011; and
 
      WHEREAS, pursuant to Resolution 7R3-c, authorized on March 21, 2012, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a First Amended Sub-recipient Agreement with the Sub-recipient to extend the term of the Sub-recipient Agreement from January 1, 2011 through December 31, 2011 to January 1, 2011 through December 31, 2012 to allow the Sub-recipient to complete the project; and
 
WHEREAS, the Sub-recipient has requested authorization for a Second Amended Agreement extending the term of the Sub-recipient Agreement for an additional nine (9) months for an amended term of January 1, 2011 to September 30, 2013, to allow the Sub-recipient to complete the project; and
 
WHEREAS, this amendment does not require the use of additional funds and all other terms and conditions contained in Sub-recipient Agreement authorized under Resolution 7R1-c 100511 shall remain in full effect.  
            
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a Second Amended Sub-recipient Agreement, in the form attached hereto, with Clinton Hill Community and Early Childhood Center, Inc., 420 Hawthorne Avenue, Newark, New Jersey  07112 (the “Sub-recipient”) to amend the term of the Sub-recipient Agreement from January 1, 2011 through December 31, 2012 to January 1, 2011 through September 30, 2013 to allow the Sub-recipient to complete the  physical rehabilitation to its facility located at 420 Hawthorne Avenue, Newark, New Jersey  07112.
  1. The Second Amended Sub-recipient Agreement between the City of Newark and the Sub-recipient is hereby ratified from December 31, 2012 to the date of adoption of this authorizing resolution.
  1. This resolution and a fully executed copy of the Second Amended Sub-recipient Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
  1. This amendment does not require the use of additional funds and all other terms and conditions contained in the Sub-recipient Agreement, authorized pursuant to Resolution 7R1-c 100511, shall remain in full effect and in accordance with the law.
 
 
STATEMENT
 
This Resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Second Amended Sub-recipient Agreement with Clinton Hill Community and Early Childhood Center, Inc., 420 Hawthorne Avenue, Newark, New Jersey  07112 (the “Sub-recipient”) to amend the term of the Sub-recipient Agreement from January 1, 2011 through December 31, 2012 to January 1, 2011 to September 30, 2013 to allow the Sub-recipient to complete the  physical rehabilitation to its facility located at 420 Hawthorne Avenue, Newark, New Jersey  07112.
