WHEREAS, the Superior Officers’ Association (SOA) has been certified by the Public Employment Relations Commission as the majority representative for certain Superior Police Officers of the City of Newark, New Jersey, as that term is defined in the New Jersey Employer-Employee Relations Act, N.J.S.A. 34:13A-1 et seq.; and
WHEREAS, the City of Newark has negotiated in good faith with said majority representative over terms and conditions of employment for the period covering January 1, 2013 through December 31, 2015; and
WHEREAS, the SOA filed an unfair practice charge with the Public Employment Relations Commission (PERC), In the Matter of City of Newark and Newark Police Superior Officers’ Association, Docket No. CP-2014-268resulting in a Decision and Order (P.E.R.C. No. 2016-56) requiring the City to present the document identified as the Collective Negotiations Proposal Between the City of Newark and the Police Superior Officers’ Association Newark New Jersey N.J. INC. (hereinafter “Successor Agreement”) dated March 18, 2014 upon the City’s receipt of the SOA President signed and SOA membership ratified Successor Agreement to the Municipal Council for consideration; and
WHEREAS, as a result of the Order of the Commission, the terms and conditions of employment for the aforementioned period have been imposed upon the parties and are incorporated into the Successor Agreement. The Successor Agreement shall be binding upon all employees in the unit represented by said majority representative, whether or not they are members of such representatives, as provided in N.J.S.A. 34:13A-5.3.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and the Business Administrator of the City of Newark are authorized on behalf of the City of Newark to execute the Successor Agreement dated March 18, 2014.
2. The Municipal Council of the City of Newark authorizes and ratifies the Successor Agreement between the City of Newark and the Superior Officers’ Association from the period January 1, 2013 to the date of adoption of this Resolution by the Municipal Council.
3. The executed copy of the Successor Agreement shall be filed with the Office of the City Clerk and the Public Employment Relations Commission c/o Public Sector Librarian, IMLR Library - Rutgers University, Ryders Lane and Clifton Avenue, New Brunswick, New Jersey 08903 as required by N.J.S.A. 34:123A-8.2 by the Director of Personnel.
STATEMENT
This Resolution authorizes and ratifies the execution of a Successor Agreement between the City of Newark and the Superior Officers’ Association covering the period of January 1, 2013 through December 31, 2015.
