WHEREAS, pursuant to Resolution 7R3-D, authorized on September 6, 2012, the Municipal Council authorized the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development to enter into and execute a Fair and Open Agreement with Newark School of the Arts, Inc., (the “Entity”) for the period of January 1, 2012 through December 31, 2012, for the amount of $125,000.00, for the purpose of providing physical rehabilitation services to its facility located at 89 Lincoln Park, Newark, New Jersey 07102 (“Agreement”); and
 
WHEREAS, the Agreement has expired and parties wish to enter into a First Amended Agreement extending the term of the Agreement for an amended period of January 1, 2012 through December 31, 2013, to permit the Entity to complete the above-referenced physical rehabilitation services to its above-referenced facility.
 
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
  1. The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a First Amended Agreement, in the form attached hereto, to amend the term of the Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow the Entity to complete the physical rehabilitation to its facility located at 89 Lincoln Park, Newark, New Jersey 07102; and
  1. The First Amended Agreement between the City of Newark and the Entity is hereby ratified from December 31, 2012 to the date of adoption of this authorizing resolution.
  1. This resolution and a fully executed copy of the First Amended Agreement shall be filed with the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.
  1. This First Amended Agreement does not require the use of additional funds and all other terms and conditions contained in the Agreement authorized pursuant to Resolution 7R3-D adopted by the Newark Municipal Council on September 6, 2012 shall remain in full force and effect and in accordance with the law.
 
 
STATEMENT
 
This resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a First Amended Agreement, in the form attached hereto to amend the term of the Agreement from January 1, 2012 through December 31, 2012 to January 1, 2012 through December 31, 2013 to allow the Entity to complete the physical rehabilitation to its facility.
