WHEREAS, Resolution 7R4Jadopted May 2, 2012, authorized the Director of the Department of Engineering to execute Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14 with EIC Inspection Agency Corporation, 3705 Kennedy Boulevard, Jersey City, New Jersey 07307, at no cost to the City, for a term of two (2) years, from May 19, 2012 through May 18, 2014; and
WHEREAS, the Contract and the authorizing resolution allowed the City of Newark to exercise an option to extend the contract for an additional one year period; and
WHEREAS, on March 11, 2014, the City of Newark exercised the option to extend the contract; and
WHEREAS, on March 12, 2014, EIC Inspection Agency Corporation accepted the option to extend Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, for an additional one year period; and
WHEREAS, the Director of the Department of Engineering desires to amend Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, to extend the contract term from May 19, 2012 through May 18, 2014 to May 19, 2012 through May 17, 2015, at no cost to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of Engineering, are hereby authorized to execute Amendment #1 to Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, with EIC Agency Corporation, 3705 Kennedy Boulevard, Jersey City, New Jersey 07307, covered by N.J.A.C. 5:23-4.14, to amend the term from May 19, 2012 through May 18, 2014 to May 19, 2012 through May 17, 2015.
2. All other terms and conditions of Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, shall apply and remain in full force and effect.
3. No Certification of Funds is required for this contract since the funds to pay the private on-site inspection agency to serve as the on-site Elevator Sub-Code Official will be generated from the fees collected for elevator inspections. No fees need to be paid to the agency if an inspection does not take place, and no fees are generated.
4. No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
5. A fully executed copy of this Amendment #1 shall be filed in the Office of the City Clerk by the Director of Engineering or his designee.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Director of Engineering, to execute Amendment #1 to Contract #05-2012 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, with EIC Inspection Agency Corporation, 3705 Kennedy Boulevard, Jersey City, New Jersey 07307, by amending the contract term from May 19, 2012 through May 18, 2014 to May 19, 2012 through May 17, 2015, at no additional cost to the City.
