WHEREAS, the North Jersey Transportation Planning Authority (NJTPA) and the State of New Jersey, Department of Transportation (NJDOT) provides funds for Local Safety Programs; and
WHEREAS, on June 15, 2015, the North Jersey Transportation Planning Authority (NJTPA) invited the City of Newark to submit proposals for the FY 2016-2017 solicitation of the Local Safety and High Risk Rural Roads Program; and
WHEREAS, on September 1, 2015, the City of Newark, Department of Engineering submitted a proposal for the FY 2016-2017 Local Safety Program High Risk Rural Roads Program to the North Jersey Transportation Planning Authority (NJTPA) for the Broad Street Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $3,475,000.00; and
WHEREAS, as a result of this proposal, the City of Newark was notified on February 25, 2016 by the North Jersey Transportation Planning Authority (NJTPA) that the North Jersey Transportation Planning Authority (NJTPA) Board of Trustees had approved grant funding through the FY 2016-2017 Local Safety High Risk Rural Roads Program for the Broad Street Pedestrian Safety Corridor Improvements, in the amount of $3,475,000.00; and
WHEREAS, no municipal funds are required for receipt or acceptance of this grant award; and
WHEREAS, upon notification of final authorization of this project from NJDOT, the Director of the Department of Engineering shall submit a copy of the authorization letter and the grant/project agreement to the Corporation Counsel and the Business Administrator for review, approval, and signature.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to submit a proposal for the FY 2016-2017 Local Safety High Risk Rural Roads Program to the North Jersey Transportation Planning Authority (NJTPA) for the Broad Street Pedestrian Safety Corridor Improvements requesting grant funding in the amount of $3,475,000.00, with no City funds required (a copy of the proposal is attached hereto and made a part hereof).
2. The Municipal Council hereby ratifies its authorization of this FY 2016-2017 Local Safety High Risk Rural Roads Program proposal from the date of submission of the proposal to the date of adoption of this authorizing resolution.
3. The grant award in the amount of $3,475,000.00 for the Broad Street Pedestrian Safety Corridor Improvements from the New Jersey Department of Transportation is hereby accepted (a copy of the award letter is attached hereto and made a part hereof).
4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized to enter into and execute grant documents with the New Jersey Department of Transportation to receive and expend the grant award in the amount of $3,475,000.00 for the Broad Street Pedestrian Safety Corridor Improvements.
5. Upon notification of final authorization of this project, the Director of the Department of Engineering shall submit a complete copy of the grant/project agreement and any associated documents to both the Corporation Counsel and the Business Administrator for review, approval, and signature.
6. No municipal funds are required for receipt or acceptance of this grant award.
7. The Director of Engineering shall file a fully-executed copy of the grant proposal, the grant award letter, the final authorization letter, and the grant/project agreement in the Office of the City Clerk.
STATEMENT
This resolution ratifies and authorizes the actions taken by the City of Newark, Department of Engineering to submit the FY 2016-2017 Local Safety High Risk Rural Roads Program proposal for grant funding from the North Jersey Transportation Planning Authority (NJTPA) for the Broad Street Pedestrian Safety Corridor Improvements and furthermore, ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Engineering, to enter into and execute an agreement with and accept grant funds in the amount of $3,475,000.00 from the North Jersey Transportation Planning Authority (NJTPA) for the Broad Street Pedestrian Safety Corridor Improvements. No municipal funds are required for receipt or acceptance of this grant award.
