WHEREAS, the Municipal Council is desirous of supporting the Summer Movies Under the Stars/Back to School Night at Branch Brook Park (between Ballantine Parkway and Elwood Avenue), Newark, New Jersey 07104, Friday, August 28, 2026 (rain date, Friday, September 11, 2026), from 4:00 P.M. until 9:30 P.M.; and

 

WHEREAS, the Municipal Council has indicated its support for this wholesome event by supporting the issuance of a Hold Harmless and Indemnification Agreement, by the City of Newark Insurance Fund Commission, for the benefit of Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104.

 

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Municipal Council supports the issuance of a Hold Harmless and Indemnification Agreement, drawn by the City of Newark Insurance Fund Commission, for the benefit of the Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for any claims arising out of the City of Newark’s use of Branch Brook Park (between Ballantine Parkway and Elwood Avenue), Newark, New Jersey 07104, on Friday, August 28, 2026 (rain date, Friday, September 11, 2026), from 4:00 P.M. until 9:30 P.M., for the Summer Movies Under the Stars/Back to School Night.

 

2.                     The City Clerk, on behalf of the Municipal Council, shall forward a true copy of the Hold Harmless and Indemnification Agreement to the Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for their records.

 

3.                     A copy of the executed Hold Harmless and Indemnification Agreement drawn by the City of Newark Insurance Fund Commission shall be filed in the Office of the City Clerk.

 

 

STATEMENT

 

This Resolution supports the issuance, by the City of Newark Insurance Fund Commission, of a Hold Harmless and Indemnification Agreement for the benefit of the Essex County Department of Parks, Recreation and Cultural Affairs, 115 Clifton Avenue, Newark, New Jersey 07104, for any claims arising out of the City of Newark’s use of Branch Brook Park (between Ballantine Parkway and Elwood Avenue), Newark, New Jersey 07104, on Friday, August 28, 2026 (rain date, Friday, September 11, 2026), from 4:00 P.M. until 9:30 P.M., for the Summer Movies Under the Stars/Back to School Night, sponsored by Council Member Anibal Ramos, Jr.
