Additional Information:
Resolution 7R2-a adopted on February 5, 2020 accepted a partial grant award, a HIV Emergency Relief Grant for the FY 2020, in the amount of $8,449,527.00 for the HIV Emergency Relief Program.
An Amending Resolution to accept additional funds in the amount of $4,106,986.00 for a total grant amount of $12,556,513.00 will be submitted under separate cover by the Department of Health and Community Wellness as Legistar File #20-1011.

WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $4,106,986.00 for the HIV Emergency Relief Program and no adequate provision has been made in the 2020 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by authorizing resolution 7R2-a adopted on February 5, 2020, the City of Newark (the “City”) accepted and inserted a partial award for the HIV Emergency Relief Grant in the amount of $8,449,527.00; and
WHEREAS, by the award letter dated April 8, 2020, the U.S. Department of Health and Human Services/Health Resources and Services Administration (HRSA) has awarded the City additional funds for the HIV Emergency Relief Program in the amount of $4,106,986.00 bringing total program resources to $12,566,513.00; and
WHEREAS, a previous resolution authorizing TE #47 and prior emergency appropriations submitted for Municipal Council approval totaled $442,058,007.78; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2020, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$446,164,993.78.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

STATEMENT
This resolution amends and authorizes the temporary emergency appropriation for the HIV Emergency Relief Program in the additional grant amount of $4,106,986.00 bringing the total program resources to $12,556,513.00. The U.S. Department of Health and Human Services/Health Resources and Services Administration has awarded the funds. The project period is March 1, 2020 through February 28, 2021.
