WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of $1,508,100.00 for the Ryan White HIV/AIDS - Ending the Epidemic (ETE) Program and no adequate provision has been made in the 2022 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, the Municipal Council adopted Resolution 7R1-c(S) dated April 12, 2022 in the amount of $492,300.00 to provide funds Ryan White HIV/AIDS Program; and
WHEREAS, by Award Letter dated May 26, 2022, the U.S. Department of Health and Human Services/Health Resources and Services Administration (HRSA) increased the City of Newark funds for the Ryan White HIV/AIDS - Ending the Epidemic (ETE) Program by $1,508,100.00 bringing the total program resources to $2,000,400.00. The aforementioned program will provide funds for the provision of health care and supportive services to the residents of the City of Newark; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriation adopted in 2022, pursuant to N.J.S.A. 40A: 4-20 including this Resolution total………………$412,693,078.23.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the following temporary emergency appropriation:
2. A temporary emergency appropriation be and the same is hereby made for the following classification.

3. Said emergency appropriation is ratified from March 1, 2022 to the date of adoption of this authorizing Resolution.
4. The temporary emergency appropriation shall be provided for in the 2022 budget.
5. A copy of this Resolution shall be filed with the Director of Local Government Services by the Acting City Clerk.
STATEMENT
This Resolution establishes the revenue and temporary emergency appropriation for the Ryan White HIV/AIDS - Ending the Epidemic (ETE) Program in the amount of $1,508,100.00. The U.S. Department of Health and Human Services/Health Resources and Services Administration awarded the funds. The project period is March 1, 2022 through February 28, 2023.
