WHEREAS, an emergency has arisen in the Special Item of Appropriation in the amount of Four Hundred Twenty-Four Thousand Two Hundred Twenty-Six Dollars and Seventy-Two Cents ($424,226.72) for the City of Newark (the, “City”) for equipment acquisition, and no adequate provision has been made in the 2025 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, as described in a Memorandum of Understanding dated May 15, 2025, (the “MOU”) the New Jersey Department of Health (the “NJDOH”), awarded an appropriation to Newark Beth Israel Medical Center (“NBIMC”) funds in the amount of Four Hundred Twenty Four Thousand Two Hundred Twenty-Six Dollars and Seventy Two Cents ($424,226.72) (the Beth Israel Medical Center Program”) and,
WHEREAS, NBIMC agrees to provide, from the Beth Israel Medical Center Program, a restricted grant to the City. The City will use the funds to purchase certain equipment as described in the MOU. The equipment purchased will be used to provide health care and supportive services to the residents of the City of Newark; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body, by a two-thirds vote, may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2025, pursuant to N.J.S.A. 40A: 4-20 including this Resolution total………………$ 60,082,548.84

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Governing Body by a two-thirds vote of its full membership hereby amends its temporary budget by making the following temporary emergency appropriation:
2. A temporary emergency appropriation be and the same is hereby made for the following classification.

3. The temporary emergency appropriation shall be provided for in the 2025 budget.
4. A copy of this Resolution shall be filed with the Director of Local Government Services by the City Clerk.
STATEMENT
This Resolution establishes the temporary emergency appropriation for the Beth Israel Medical Center Program FY 2025, in the amount of Four Hundred Twenty-Four Thousand Two Hundred Twenty-Six Dollars and Seventy-Two Cents ($424,226.72). The New Jersey Department of Health (the “NJDOH”) awarded the funds to Newark Beth Israel Medical Center. The project period is March 1, 2025, through December 31, 2025.
