WHEREAS, the Governing Body of City of Newark desires to further the public interest by applying for a grant from the State of New Jersey, Department of Environmental Protection (Watershed and Land Management) in the amount of $286,400.00 to fund the project for Lake(s) - algal control treatment and Echo Lake Protection Plan; and

WHEREAS, on February 28, 2022 the Director of the Department of Water and Sewer Utilities submitted a Proposal on behalf of the City of Newark, to the New Jersey Department of Environmental Protection's Request for Proposals for Water Quality Restoration Grant (2020-2022) requesting funding in the amount of $286,400.00 to mitigate Nonpoint Solution Pollution for the City's project of Lake(s) - Algal Control Treatment and Echo Lake Protection Plan; and

WHEREAS, as a result of this application, the City of Newark (the "City")has been awarded a grant in the amount of $286,400.00 with a one-time grant coverage for the years 2023, 2024 and 2025, from the New Jersey Department of Environmental Protection for Lake(s) - Algal Control Treatment and Echo Lake Protection Plan for the period commencing upon full execution of the Grant Agreement; and

WHEREAS, the City must execute a Grant Agreement with the New Jersey Department of Environmental Protection in order to obtain the grant award of $286,400.00, no municipal funds are required.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities are hereby authorized to submit an application to the New Jersey Department of Environmental Protection requesting funding in the amount of $286,400.00 from the Water Quality Restoration 2020-2022 for Lake(s) - Algal Control Treatment and Echo Lake Protection Plan with no municipal funds required (a copy of the online application is attached hereto and made a part hereof).

2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing Resolution.

3. The Water Quality Restoration Grant 2020-2022 award in the amount of $286,400.00 from the New Jersey Department of Environmental Protection is hereby accepted (a copy of the online award notification is attached hereto and made a part hereof).

4. The Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, are hereby authorized to enter into and execute the Water Quality Restoration 2020 documents with the New Jersey Department of Environmental Protection to receive and expend the Water Quality Restoration 2020-2022 award in the amount of $286,400.00 for Lake(s) - Algal Control Treatment and Echo Lake Protection Plan for the period commencing upon full execution of the Grant Agreement (a copy of the Agreement is attached hereto and made a part hereof).

5. The Grant Agreement between the City and the New Jersey Department of Environmental Protection is hereby ratified from the date of the Award Notification on July 19, 2022 to the date of adoption of this authorizing Resolution with a one-time grant coverage for the years 2023, 2024 and 2025.

6. No municipal funds are required for receipt or acceptance of this Water Quality Restoration 2020-2022 award.

7. The Director of the Department of Water and Sewer Utilities shall file a fully-executed copy of the Water Quality Restoration 2020 application, the online award notification, the Water Quality Restoration 2020-2022 agreement, in the Office of City Clerk.


STATEMENT

This Resolution ratifies and authorizes the actions taken by the Director of the Department of Water and Sewer Utilities to submit an application for Water Quality Restoration 2020-2022 funding from the New Jersey Department of Environmental Protection for Lake(s) - Algal Control Treatment and Echo Lake Protection Plan, for a one-time grant coverage for the years 2023, 2024 and 2025 and furthermore, ratifies and authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Water and Sewer Utilities, to accept the Water Quality Restoration 2020-2022 funds in the amount of $286,400.00 from the New Jersey Department of Environmental Protection for Lake(s) - Algal Control Treatment and Echo Lake Protection Plan and to enter into and execute a Grant Agreement for the period commencing upon full execution of the Grant Agreement. No municipal funds are required.
