WHEREAS, the State of New Jersey Department of Environmental Protection, Green Acres Program (the "State"), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and

WHEREAS, the City of Newark (the "City") has previously obtained a Green Acres loan of $0 and/or a Green Acres grant of Two Million Six Hundred Thousand Dollars and Zero Cents ($2,600,000.00) from the State [and an Urban Parks grant of Five Hundred Thousand Dollars and Zero Cents ($500,000.00)] from the State to fund the following project(s) 0714-21-UPG; 0714-21-011Broadway Park; and

WHEREAS, the City of Newark desires to further the public interest by requesting an additional Green Acres loan of $0 and/or an additional Green Acres grant of $4,260,000.00 [and an additional Urban Parks grant of $0 from the State to fund the project(s); and

WHEREAS, the State shall determine if the supplemental funding request is complete and in conformance with the scope and intent of the Green Acres Program, and notify the applicant of the amount of the funding award; and

WHEREAS, the applicant is willing to use the State's funds in accordance with such rules, regulations, and applicable statutes, and is willing to enter into an agreement with the State for the above-named project.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior Services, are hereby authorized to: (a) request such a loan and/or grant; (b) provide additional application information and furnish such documents as may be required; and (c) act as the authorized correspondent for the City of Newark in its application.

2. The applicant agrees to provide the local government/nonprofit share if match is required.

3. The applicant agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project; and

4. This Resolution shall take effect immediately.


STATEMENT

This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Recreation, Cultural Affairs and Senior and the action taken to apply for grant funding from the New Jersey Department of Environment Protection, Green Acres Program, 501 East State Street, Trenton, New Jersey 08625-0806, in the amount of $4,260,000.00, for supplemental grant funds to redesign Broadway Park and develop the site into a new city park, for the period commencing May1, 2024 and through December 31, 2026.
