AN ORDINANCE APPROVING THE CONVEYANCE OF A TWO MONTH TEMPORARY EASEMENT OVER CITY OWNED PROPERTY AS INDICATED ON THE ATTACHED AGREEMENT AND MAP ENTITLED “PARCEL E105G” TO THE STATE OF NEW JERSEY DEPARTMENT OF TRANSPORTATION, IN ACCORDANCE WITH N.J.S.A. 40A:12-13 (b)(1) FOR THE SUM OF ONE HUNDRED DOLLARS AND ZERO CENTS ($100.00). (335-347 RAYMOND BOULEVARD, BLOCK 2407, LOT 81) (EAST WARD)

WHEREAS, the City of Newark is the owner of property located at 335-347 Raymond Boulevard, Rear, also known as Tax Block 2407, Lot 81 (the “Property”); and
WHEREAS, the New Jersey Department of Transportation (“NJDOT”) seeks to acquire a temporary work easement on a portion of the Property; and
WHEREAS, the City has negotiated the Site Work Agreement (the “Agreement”) with NJDOT, annexed hereto as Exhibit “A”, outlining the terms of access to the Property; and
WHEREAS, the Agreement provides for a temporary easement on a portion of the Property, known as “Parcel E105G”, as described on the Metes and Bounds Description annexed to the Agreement as Schedule “A”, and the map entitled “Parcel E105G” annexed to the Agreement as Exhibit “B”; and
WHEREAS, the duration of the temporary easement is estimated to be two (2) months from the date of acquisition; and
WHEREAS, the City of Newark has determined that Parcel E105G is no longer needed for public use; and
WHEREAS, NJDOT has provided an appraisal, annexed to the Agreement as Exhibit “C”, dated May 19, 2017, performed by Raymond Underhill, which values the Temporary Work Easement Area at One Hundred Dollars and Zero Cents ($100.00); and
WHEREAS, pursuant to Local Lands and Buildings Law, N.J.S.A. 40A: 12-13 (b)(1), the City of Newark is authorized to convey property that is not needed for municipal purposes to any department of the State of New Jersey without public bidding; and
WHEREAS, the Parcel is located adjacent to the existing elevated ramp from the Pulaski Skyway to Raymond Boulevard near the entrance to the PSE&G substation and Covanta Essex co-generation plant; and
WHEREAS, NJDOT desires to acquire a temporary easement on the Property from the City of Newark for the completion of the Pulaski Skyway rehabilitation project by purchasing the easement by private sale for the appraised value of One Hundred Dollars and Zero Cents ($100.00) pursuant to N.J.S.A. 40A:12-13 (b)(1).
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
SECTION 1. The City hereby authorizes that a temporary work easement on a portion of the City-owned property located at 335-347 Raymond Boulevard, Rear, known on the tax maps of the City of Newark as Block 2407, Lot 81 described as Parcel E105G (on the metes and bounds description (Schedule “A”) and map entitled “Parcel E105G” (Exhibit “B”) annexed to the Agreement) be granted to the State of New Jersey Department of Transportation, a public body corporate and politic, for the completion of the Pulaski Skyway rehabilitation project by private sale for the appraised value of One Hundred Dollars and Zero Cents ($100.00), pursuant to N.J.S.A. 40A:12-13 (b) (1).
SECTION 2. The Acting Director of the Department of Economic and Housing Development is hereby authorized to enter into and execute the Site Work Agreement, in the form attached hereto, granting a temporary work easement on a portion of the City property located at 335-347 Raymond Boulevard, Rear, known on the tax maps of the City of Newark as Block 2407, Lot 81 described as Parcel E105G, any and all other documents which may be necessary, in order to effectuate the private sale of the temporary work easement on the above property all in forms subject to the approval of the City of Newark’s Acting Corporation Counsel.
SECTION 3. The Director of Finance is hereby authorized to place the consideration of $100.00 in the Redevelopment Trust Fund.
SECTION 4. That the copies of the executed Site Work Agreement shall be placed on file in the Office of the City Clerk by the Acting Director of the Department of Economic and Housing Development.
SECTION 5. This Ordinance shall take effect upon final passage and publication in accordance with the laws of the State of New Jersey.
STATEMENT
Passage of this Ordinance will permit the City of Newark to convey a temporary work easement, of approximately two months, on a portion of the City property located at 335-347 Raymond Boulevard, Rear, known on the tax maps of the City of Newark as Block 2407, Lot 81 described as Parcel E105G not needed for a public use to the New Jersey Department of Transportation for the completion of the Pulaski Skyway rehabilitation project by private sale for the appraised value of One Hundred Dollars and Zero Cents ($100.00) pursuant to N.J.S.A. 40A:12-13 (b) (1).
