WHEREAS, the Newark Municipal Court has exhausted all judicial enforcement remedies permitted by law or court rule, N.J.S.A. 2B:19-6(a); and
WHEREAS, N.J.S.A. 2B:19-6, authorizes the use of private collection agencies to collect outstanding debt payable to municipal courts; and
WHEREAS, the Supreme Court of the State of New Jersey, has issued rules and procedures governing the collection of Municipal Court Debt Under L. 2009, C.233, dated March 31, 2011, and it is the intention of the Court to comply with such rules and procedures; and
WHEREAS, on October 1, 2014, the Municipal Council adopted Resolution 7R5-b, authorizing (initiating) competitive contracting pursuant to N.J.S.A. 40A:11-4.1; and
WHEREAS, the City of Newark advertised for bids pursuant to the Competitive Contracting Law, N.J.S.A. 40A:11-4.1 for Municipal Court Collections on October 10, 2014; and
WHEREAS, seven (7) individuals/vendors requested a proposal packet; and
WHEREAS, seven (7) proposals were received on September 30, 2014, and the proposal from Gila, LLC d/b/a Municipal Service Bureau (MSB) located at 8325 Tuscany Way, Building 4, Austin, TX 78754 was found to be the most responsible bidder; and
WHEREAS, the proposal submitted by Gila, LLC d/b/a Municipal Service Bureau (MSB) will be at no cost to the City; and
WHEREAS, Gila, LLC d/b/a Municipal Service Bureau (MSB) has agreed to charge 22% administrative fee in accordance with the Supreme Court Procedures Governing the Private Collection of Municipal Court Debt Under L. 2009, C.233.; and
WHEREAS, the City of Newark wishes to enter into a contract with Gila, LLC d/b/a Municipal Service Bureau (MSB) located at 8325 Tuscany Way, Building 4, Austin, TX 78754 to provide for the private collection of debt for the City of Newark Municipal Court ("Court"), in accordance with the Supreme Court Procedures Governing the Private Collection of Municipal Court Debt Under L. 2009, C.233.; and
WHEREAS, the Municipal Council adopted the Contractor Pay-to-Play Reform Ordinance, R.O. 2:4-22C, which forbids the award of a contract to a Business Entity, as defined therein, which has made or solicited political contributions to Newark Municipal Candidates, office holders having ultimate responsibility for the award of a contract; candidate committees of the aforementioned candidates; and political or political party committees of the City of Newark or County of Essex; and continuing political committees or political action committees regularly engaged in the support of the City of Newark municipal or County of Essex elections; and certain other political party or candidate committees, in excess of certain thresholds.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and his or her designee, the Acting Finance Director and the Municipal Court Director are hereby authorized to enter in to a contract with Gila, LLC d/b/a Municipal Service Bureau (MSB) located at 8325 Tuscany Way, Building 4, Austin, TX 78754 to provide for the private collection of debt for the City of Newark Municipal Court ("Court"), in accordance with the Supreme Court Procedures Governing the Private Collection of Municipal Court Debt Under L. 2009, C.233.
2. The Municipal Council hereby authorized the use of competitive contracting, pursuant to N.J.S.A 40A:11-4.1 et seq. to award a contract for the private collection of debt for the City of Newark Municipal Court ("Court"), in accordance with the Supreme Court Procedures Governing the Private Collection of Municipal Court Debt Under L. 2009, C.233.
3. The term of this contract will be three (3) years from the adoption of this resolution with the option to renew for an additional two (2) year term for a total of five (5) years. This contract is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law (N.J.S.A. 19:33A-20.5) and pursuant to the provisions of the Local Public Contracts Law (N.J.S.A. 40A:11-5(1) (a) (i).
4. Certified copies of the fully executed contracts shall be filed with the City of Newark Municipal Clerk by the Acting Director of Finance/Chief Financial Officer of the City of Newark.
5. A notice of the award of the contract shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this Resolution.
