WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program ("State"), provides loans and/or grants to municipal and county governments and grants to nonprofit organizations for assistance in the acquisition and development of lands for outdoor recreation and conservation purposes; and
 
WHEREAS, the City of Newark (the "Applicant") desires to further the public interest by obtaining grant funding in the amount of $1,000,000.00 from the State to fund the development of the Ironbound Football Field (A-Field), located at 46-132 St Charles Street, Newark; which will provide for the installation of a multi-use synthetic turf field as well as a small playground area and concession area at a projected cost of $6,200,535.00; and
 
(a)      WHEREAS, the Department of Engineering recommends that the Office of the Business Administrator or the successor to the Office of the Business Administrator do the following: make application for such a grant,
  1. provide additional application information and furnish such documents as may be required, and
  2. act as the authorized correspondent of the above named Applicant, City of Newark; and
 
WHEREAS, the State shall determine if the application is complete and in conformance with the scope and intent of the Green Acres Program, and notify the Applicant of the amount of the funding award; and
 
WHEREAS, the Applicant is willing to use the State's funds in accordance with such rules, regulations and applicable statutes, and is willing to enter into an agreement with the State for the above named project;
 
NOW, THEREFORE, BE IT FURTHER RESOLVED BY THE MUNICIPAL COUNCIL, OF THE CITY OF NEWARK, NEW JERSEY:
 
1.      That the Business Administrator, or his designee, the Assistant Business Administrator of the City of Newark is hereby authorized to execute an agreement and any amendment thereto with the State, for the project known as the Ironbound Football Field (A-Field);
 
2.      That the applicant has its matching share of the project, if a match is required, in the amount of $1,000,000.00;
 
3.      That, in the event the State's funds are less than the total project cost specified above, the City of Newark represents that it has the balance of funding necessary ($5,200,535.00)   to complete the project:
 
4.      The City of Newark agrees to comply with all applicable federal, state, and local laws, rules, and regulations in its performance of the project;
 
5.      That this resolution shall take effect immediately;  and
 
6.  A copy of the full-executed application will be placed on file with the Office of the City Clerk.
STATEMENT
 
      This resolution authorizes the Business Administrator of the City of Newark or his designee, the Assistant Business Administrator, to submit an application to the New Jersey Department of Environmental Protection "Green Acres" Program, for grant funding for the development of the project referred to as the Ironbound Football Field (A-Field), located at 46-132 St Charles Street, Newark, New Jersey, which includes the installation of a multi-use synthetic turf field as well as a small playground area and concession area, in order to positively impact the health and overall well-being of the residents of the City of Newark.
