WHEREAS, the United States Department of Justice (“USDOJ”) has made funds available through its Edward Byrne Memorial Discretionary Grants Program to assist, among other things, local jurisdictions to reduce the incidents of crime and enhance reentry services; and

WHEREAS, the Business Administrator, authorized by Resolution 7R1-d, adopted June 18, 2008, prepared a proposal and application to USDOJ for a grant award in the amount of $424,815.00 for the Newark Returning Offender Initiative project; and

WHEREAS, the USDOJ awarded the City a $424,815.00 grant for these services and has approved a budget that includes expenditures of $135,057.19 for Case Management and Job Placement Services for 54 individuals; and

WHEREAS, pursuant to Resolution 7R1-f, adopted October 1, 2008, the City accepted grant funds and entered into a grant agreement with USDOJ, for the grant award 2008-DD-BX-0630, in the amount of $424,815.00, for the Newark Prisoner Reentry Program, for the period commencing on July 1, 2008 and terminating on December 31, 2010; and

WHEREAS, on April 7, 2010, the Business Administrator requested an extension of the grant agreement from December 31, 2010 to December 31, 2011 through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on April 14, 2010; and

WHEREAS, pursuant to Resolution 7R1-c, adopted on June 17, 2010, the City of Newark authorized an amendment to the grant agreement to extend the grant expiration date from December 31, 2010 to December 31, 2011; and

WHEREAS, the Business Administrator requests an extension of the grant agreement from December 31, 2011 to September 30, 2012 through the submission of a Grant Adjustment Notice to USDOJ, which was approved by USDOJ on June 30, 2011; and

WHEREAS, pursuant to Resolution 7R1-i, adopted on September 21, 2011, the City of Newark authorized an amendment to the grant agreement to extend the grant expiration date from December 31, 2011 to September 30, 2012; and

WHEREAS, the City of Newark, Department of Economic and Housing Development (“DEHD”), through the Office of Reentry, is in need of Case Management and Job Placement Services to assist in the implementation and administration of the Newark Reentry Initiative; and

WHEREAS, pursuant to N.J.S.A. 40A:11-4.1(b)(2), a contract for such services may be awarded through a competitive contracting process; and

WHEREAS, the City of Newark issued a Request for Proposals (“RFP”) in July 2011, subject to the New Jersey Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-20.4, to obtain proposals from vendors to provide Case Management and Job Placement Services to formerly incarcerated individuals; and

WHEREAS, five vendors submitted proposals (the “Proposals”) in response to the City’s RFP; and

WHEREAS, the Proposals were reviewed and evaluated by staff from DEHD, the Business Administrator’s Office, and select community organizations (the “Review Committee”); and

WHEREAS, Offender Aid and Restoration of Essex County, Inc. (“OAR”), located at 303 Washington Street, Third Floor, Newark, NJ, 07102, submitted a proposal to serve fifty-three (53) young adults with criminal records in response to the City’s RFP; and

WHEREAS, due to OAR’s experience and proven ability to work with formerly incarcerated individuals and the quality of its proposal, the Review Committee selected OAR as one of the vendors to provide Case Management and Job Placement Services for the Newark Returning Offender Initiative; and

WHEREAS, the City desires to enter into a contract with OAR in the amount of $110,046.60 for the purpose of providing Case Management and Job Placement Services to 44 young adults with criminal records; and

WHEREAS, this contract is being awarded to a non-profit organization and as such is not governed by State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, or Newark Executive Order on Pay to Play Reform, MEO-07-0001.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

The Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, are hereby authorized to enter into and execute a contract with Offender Aid and Restoration Inc., 303 Washington Street, Third Floor, Newark, NJ, 07102, for the purpose of providing case management and job placement services to 44 young adults with criminal records for the Newark Reentry Initiative, in an amount not to exceed $110,046.60, for the period commencing on January 1, 2012 and terminating on September 30, 2012.

The Municipal Council hereby ratifies this contract from January 1, 2012 to the date of adoption of this authorizing resolution.

Attached hereto is a Certification of Funds which states that there are available legally appropriated funds for the purpose set forth hereinabove in the amount of $110,046.00.

This contract is being awarded to a non-profit organization as such the procedures of the State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001, effective March 31, 2007 do not apply.

This contract has been awarded through a competitive contracting process in accordance with N.J.S.A. 40A:11-4.1 et seq.

A copy of the Comptroller’s Certification and the fully executed contract herein authorized shall be filed in the Office of the City Clerk by the Deputy Mayor/Director of the Department of Economic and Housing Development.






STATEMENT

This resolution ratifies and authorizes the Mayor and/or his designee, the Deputy Mayor/Director of the Department of Economic and Housing Development, to enter into and execute a Service contract with Offender Aid and Restoration inc., 303 Washington Street, Third Floor, Newark, NJ, 07102, for the purpose of providing case management and job placement services to 44 young adults with criminal records for the Newark Reentry Initiative, in an amount not to exceed $110,046.60, for the period commencing on January 1, 2012 and terminating on September 30, 2012. This contract is being awarded to a non-profit organization, and as such, State Pay to Play Law, N.J.S.A. 19:44A-20.5, and Newark Executive Order MEO-07-0001 do not apply and is awarded pursuant to the provisions of the State Local Public Contracts Law (N.J.S.A. 40A:11- 4.1(b)(2)).
