WHEREAS, on June 16, 2015, the City of Newark through its Director of Purchasing advertised for the receipt of bids from vendors to provide, 2014 or Newer, Compressed Natural Gas, Low Entry Cab Forward, Refuse Trucks, to the Department of Neighborhood & Recreational Services through the Division of Motors, as per the bid proposal attached hereto; and
WHEREAS, the Division of Central Purchasing distributed ten (10) bid proposal packages to prospective vendors following the date of advertisement; and
WHEREAS, on July 2, 2015, two (2) bids were received in response to this advertisement; and
WHEREAS, the Division of Motors Manager reviewed the bids with the Department of Neighborhood & Recreational Services and recommended an award to the lowest responsive, responsible bidder, Cambria Automotive Companies Inc.; and
WHEREAS, pursuant to N.J.S.A. 40A:11-24 the vendor agreed to hold his prices for 120 days from the bid receipt date; and
WHEREAS, on July 16, 2015, the company gave written notice that the price would not be held beyond September 30, 2015; and
WHEREAS, pursuant to N.J.S.A. 9:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1 et seq., meets the requirements of the fair and open process.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Mayor and/or his designee, the Purchasing Director, are hereby authorized to enter into a contract with Cambria Automotive Companies Inc., 116 Talmadge Road. Edison, New Jersey 08817, to provide three (3) 2014 or Newer, Compressed Natural Gas, Low Entry Cab Forward, Refuse Trucks, to the City of Newark, whose bid was received on the advertised due date and determined to be the lowest responsive, responsible bidder in accordance with the specification. Upon adoption of the resolution by the Municipal Council, the term of this contract will be, upon complete satisfactory delivery, to the City of Newark.
2. There shall be no amendment or change of this contract without the approval of the Municipal Council by resolution.
3. Funds for this acquisition are encumbered on the following Purchase Orders:
PO# 0000000002 - Fund NW029, Account 46930, B2015 for $176,915.56
PO# 0000002278 - Fund NW045, Account 46930, B2015 for $ 71,940.44
PO# 0000000001 - Fund NW029, Account 46930. B2015 for $497,712.00
in the total amount of $746,568.00 to purchase (3) three trucks.
4. It is the responsibility of the Division of Motors Manager to ascertain that the three (3) 2014 or Newer, Compressed Natural Gas, Low Entry Cab Forward, Refuse Trucks, provided by the vendor is in compliance with the specifications, and provide the Municipal Council, the Business Administrator and the Purchasing Director with appropriate reports during the term of the contract.
5. If required by the State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than 20 business days following such award, in accordance with N.J.S.A. 52:15C-10 and the notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This upon delivery of contract is awarded to Cambria Automotive Companies Inc., to provide three (3) 2014 or Newer, Compressed Natural Gas, Low Entry Cab Forward, Refuse Trucks, to the City of Newark, at a cost not to exceed $746,568.00.
