 WHEREAS, the Fraternal Order of Police, Newark Lodge No. 12 has been certified by the Public Employment Relations Commission as the majority representative for certain Police Officers of the City of Newark, New Jersey, as that term is defined in the New Jersey Employer-Employee Relations Act, N.J.S.A. 34:13A-1 et seq.; and

 

WHEREAS, the City of Newark has negotiated in good faith with said majority representative over terms and conditions of employment for the period covering January 1, 2013 through December 31, 2017; and

WHEREAS, as a result of the collective bargaining negotiations, the terms and conditions of employment for the aforementioned period have been imposed upon the parties and are incorporated into the Labor Agreement or Collective Bargaining Agreement (Agreement) attached hereto.  The Agreement shall be binding upon all employees in the unit represented by said majority representative, whether or not they are members of such representatives, as provided in N.J.S.A. 34:13A-5.3; and

WHEREAS, the financial impact of the City entering into this Agreement with the Fraternal Order of Police, Newark Lodge No. 12 will be an additional $5,220,976.00 for the life of the contract.

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor, Business Administrator and Director of Personnel of the City of Newark are authorized, on behalf of the City of Newark, to execute the Agreement attached hereto.

2.                     The financial impact of the City entering into this Labor Agreement with the Fraternal Order of Police, Newark Lodge No. 12 will be an additional $5,220,976.00 for the life of the contract.

3.                     The Municipal Council of the City of Newark ratifies this Agreement between the City of Newark and the Fraternal Order of Police, Newark Lodge No. 12, from January 1, 2013 to the date of adoption of this Resolution by the Municipal Council.

4.                     The executed copy of the Agreement shall be filed with the Office of the City Clerk and the Public Employment Relations Commission c/o Public Sector Librarian, IMLR Library - Rutgers University, Ryders Lane and Clifton Avenue, New Brunswick, New Jersey 08903 as required by N.J.S.A. 34:123A-8.2 by the Director of Personnel.

STATEMENT

 

This Resolution ratifies and authorizes the Mayor, Business Administrator and Director of Personnel of the City of Newark, on behalf of the City of Newark, to execute a Labor Agreement between the City of Newark and the Fraternal Order of Police, Newark Lodge No. 12, covering the period from January 1, 2013 through December 31, 2017.
