WHEREAS, the State of New Jersey Department of Law & Public Safety, Division of Highway Traffic Safety (DHTS), is responsible for the administration of Drunk Driving Enforcement Fund (DDEF) established by N.J.S.A. 39:4-50.8; and
WHEREAS, Municipalities, the Division of State Police, interstate law enforcement agencies and county law enforcement agencies may apply to DHTS to use DDEF monies for additional DWI enforcement patrols and any appropriate measures pertaining to other DWI enforcement activities authorized by the DDEF administrative regulations, N.J.A.C. 13:86-1.1 et seq. and approved Director; and
WHEREAS, through Resolution 7R11-a, adopted on November 4, 2010 (see attached), the Municipal Council ratified and authorized the Mayor and/or his designee the Director of Police to accept a grant award in the amount of $32,676.41 from the DHTS to use DDEF monies for additional DWI enforcement patrols for a period commencing on August 11, 2010 and not to exceed one (1) year; and
WHEREAS, the monies were placed into a budget line in order to be expended for the purpose of DWI enforcement patrols and there remains monies within the budget line; and
WHEREAS, the Police Department is requesting an amendment to Resolution 7R11-a November 4, 2010 to extend the contract period until the completion of all grant funding to allow for the expenditure of grant monies as authorized by the grant; and
WHEREAS, all other terms and conditions contained in the contract authorized under 7R11-a November 4, 2010, not otherwise amended herein, shall remain in full effect and in accordance with the law.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
- Resolution 7R11-a, adopted on November 4, 2010, is amended to extend the time that the grant funds may be expended until such time that all the grant funds are depleted.
- No municipal funds are required for receipt or acceptance of this grant.
STATEMENT
This resolution amends Resolution 7R11-a, adopted on November 4, 2010, and authorizes the Mayor and/or his designee, the Director of Police, to extend the grant project period, in order to expend the grant award in the amount of $32,676.41 from the State of New Jersey Department of Law & Public Safety, Division of Highway Traffic Safety (DHTS), Drunk Driving Enforcement Fund for the purpose of conducting DWI enforcement activities within the City of Newark until the depletion of all grant monies.
