WHEREAS, on or about October 27, 2015, the City of Newark, through its Corporation Counsel, advertised on the City’s website a Notice of Request for Qualifications (“RFQ”) for legal services for: (1) Environmental Litigation Counsel; (2) Environmental Litigation Services for Remediation of Environmentally Contaminated Properties within the City; and (3) Redevelopment Matters; and
WHEREAS, on December 29, 2015 the Municipal Council through resolutions 7R7-d(S); 7R7-f(S); and 7R7-z(S) awarded Decotiis, Fitzpatrick & Cole, LLP, Glenpointe Centre West, 500 Frank W. Burr BLVD., Ste. 31, Teaneck, New Jersey, 07666 three (3) separate contracts to provide legal services to City as (1) Environmental Litigation Counsel; (2) Litigation Counsel for Remediation of Environmentally Contaminated Properties within the City; and (3) Redevelopment Counsel; and
WHEREAS, the Office of Corporation Counsel, after further analysis and review of its existing contract with Decotiis, Fitzpatrick & Cole, LLP, concluded it is more efficient and in the best interest of the City to rescind 7R7-d(S); 7R7-f(S) (Environmental Related Legal Services) adopted on December 29, 2015, and place the contracts for those legal services within the current contract for Litigation Defense as authorized and ratified through resolution 7R7-c(S/AS) on March 3, 2016 in an amount not to exceed $125,000.00 for services from January 1, 2016, through December 31, 2016; and
WHEREAS, 7R7-z(S) adopted on December 29, 2015 should also be rescinded as the firm of Decotiis, Fitzpatrick & Cole, LLP was previously awarded a contract through the Department of Economic and Housing Development for Redevelopment Matters and it is duplicative to give the firm another contract for redevelopment work; and
WHEREAS, the Corporation Counsel does not intend to execute the contracts authorized by Resolutions 7R7-D(S); 7R7-f(S); and 7R7-z(S) adopted on December 29, 2015, therefore, requests the Municipal Council rescind the resolutions; and
WHEREAS, the Municipal Council agrees with the Corporation Counsel and finds it is appropriate to rescind Resolutions 7R7-d(S), 7R7-f(S), and 7R7-z(S) adopted on December 29, 2015.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolutions 7R7-d(S), 7R7-f(S), and 7R7-z(S) adopted on December 29, 2015, are rescinded.
STATEMENT
Resolution rescinding 7R7-d(S), 7R7-f(S) and 7R7-z(S) adopted on December 29, 2015, which authorized the execution of three separate contracts to Decotiis, Fitzpatrick & Cole, LLP, to provide legal services for Environmental Counsel, Litigation Services for Remediation of Environmentally Contaminated Properties within the City and Redevelopment Matters in an amount not to exceed $25,000.00 for each contract.
