Additional Information: 

An emergency Contract #E2023-08 was awarded to eight (8) vendors in a contract amount not to exceed $2,627,280.00 for the period of June 6, 2023 through September 5, 2023, for the Office of Homeless Services.

 

The 1st extension and amendment of Emergency Contract #E2023-08 provided an extension to the contract period through December 31, 2023, or until new contract(s) were awarded, whichever occurred first, and increased the contract by $2,719,035.00, for a new total contract amount not to exceed $5,346,315.00.

 

The 2nd extension and amendment of Emergency Contract #E2023-08 provided an extension to the contract period through May 31, 2024, or until new contract(s) were awarded, whichever occurred first, and increased the contract by $4,531,725.00, for a new total contract amount not to exceed $9,925,600.00.

 

The 3rd extension and amendment of Emergency Contract #E2023-08, provided an extension to the contract period through August 29, 2024, or until new contract(s) are awarded, whichever occurs first, and increases the contract by $2,719,035.00, for a new total contract amount not to exceed $12,644,635.00.

 

This Resolution provides for a 4th extension and amendment of Emergency Contract #E2023-08, extending the contract period through November 30, 2024, or until new contract(s) are awarded, whichever occurs first, and increases the contract by $2,719,035.00, for a new total contract amount not to exceed $15,363,670.00.

 WHEREAS, on June 5, 2023, the Office of Homeless Services requested a declaration of emergency for temporary housing services to ensure the health, safety and wellness of the homeless population located at 224 Sussex Avenue after various inspections revealed serious violations and unhealthy conditions at the facility; and

 

                     WHEREAS, on July 7, 2023, the Qualified Purchasing Agent declared an emergency for Temporary Shelter Services in the amount of Two Million Six Hundred Seventy Four Thousand Eight Hundred Forty Dollars and Zero Cents ($2,674,840.00) for nine (9) vendors: Newly Destined Inc., 1114-1116 Broad Street Newark, New Jersey 07114; 169 Clinton Development Urban Renewal, LLC, 246 Danforth Avenue, Jersey City, New Jersey 07305; Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107;  Real House, Inc., 95 Grove Street, Montclair, NJ 07042;  The Restoration Center, Inc., 300 South 12th Street, Newark, New Jersey 07103; United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103; YMCA of Newark and Vicinity, 600 Broad Street, Newark, New Jersey 07102;  Helping the Homeless, Inc., 12 Moryan Road, Edison, New Jersey 08817; and Positive Health Care Inc., 395-406 University Avenue, Newark, New Jersey 07102; and

 

                      WHEREAS, the first extension of emergency contract #E2023-08 was adopted as 7R1-c on October 18, 2023, which increased the total contract amount to Five Million Three Hundred Ninety-Three Thousand Eight Hundred Seventy-Five Dollars and Zero Cents ($5,393,875.00) for the period of September 4, 2023 through December 31, 2023;  the second  extension of emergency contract #E2023-08 was adopted as 7R1-h on April 10, 2024, which increased the total contract amount to Nine Million Nine Hundred Twenty-Five Thousand Six Hundred Dollars and Zero Cents ($9,925,600.00) for the period of through June 1, 2024 through August 29, 2024; and the third extension of emergency contract #E2023-08 was adopted as 7R1-a(s) on June 25, 2024, which increased the total contract amount to Twelve Million Six Hundred Forty-Four Thousand Six Hundred Thirty-Five Dollars and Zero Cents ($12,644,635.00) for the period

 

                     WHEREAS, the Division of Central Purchasing is in the process of soliciting proposals for Emergency Housing Services; and

 

                     WHEREAS, the Office of Homeless Services continues to be in immediate and emergent need to provide temporary housing services to the homeless population; and

 

                     WHEREAS, N.J.S.A. 40A:11-6 provides that Emergency Contracts may be entered into when an emergency affecting the public health, safety, or welfare requires the immediate delivery of goods or the performance of service; and

 

                     WHEREAS, the Office of Homeless Services desires to (1) ratify and extend Emergency Contract E2023-08 for the period commencing from August 30, 2024, through November 30, 2024, or until such time contracts are in place, whichever occurs first, and (2) increase the contract by Two Million Seven Hundred Nineteen Thousand Thirty-Five Dollars and Zero Cents ($2,719,035.00), bringing the new total contract to exceed Fifteen Million Three Hundred Sixty-Three Thousand Six Hundred Seventy Dollars and Zero Cents ($15,363,670.00); and

 

                     WHEREAS, N.J.A.C. 5:34-6.1(a)(3) provides that the emergency purchasing procedure may be used when the need for such goods or services has arisen notwithstanding a good faith effort on the part of a municipality to plan for the purchase of any goods or services required by the municipality; and

 

                     WHEREAS, it is a matter of public health, safety and welfare that the above-described emergency contract be extended because the City of Newark still needs to ensure the safe and uninterrupted services and any interruption of the services would pose an imminent harm to the health, safety and welfare of the homeless population in the City of Newark; and

 

                     WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b)(c) limits the period of Emergency Contracts to ninety (90) days and no extensions of Emergency Contracts shall be permitted without authorization by the Municipal Council by Resolution; and

 

                     WHEREAS, the Municipal Council has the exclusive authority to extend an emergency; and

 

                     WHEREAS, the Office of Homeless Services now seeks authorization by the Municipal Council to ratify and extend the emergency to prevent interruption of the declaration of emergency until the Emergency is abated for the temporary housing of the homeless population.

 

 

   NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor, and/or his designees, the Business Administrator, and/or the Qualified Purchasing Agent, QPA, are hereby authorized to execute an extension of Emergency Contract #E2023-08 for the following vendors: 1) Newly Destined Inc., 1114-1116 Broad Street, Newark, New Jersey 07114, 2)169 Clinton Development Urban Renewal LLC, 246 Danforth Avenue, Jersey City, New Jersey 07305, 3) Catholic Charities of the Archdiocese of Newark, 590 North 7th Street, Newark, New Jersey 07107, 4) Real House Inc., 95 Grove Street, Montclair, New Jersey 07042, 5) The Restoration Center, Inc., 300 South 12th Street, Newark, New Jersey 07103, 6) United Community Corporation, 332 South 8th Street, Newark, New Jersey 07103, 7) YMCA of Newark and Vicinity, 600 Broad Street, Newark, New Jersey 07102, 8) Helping the Homeless, Inc., 12 Moryan Road, Edison, New Jersey 08817, and 9) Positive Health Care, Inc., 395-406 University Avenue, Newark New Jersey 07102; for the period commencing on January 1, 2024 through March 31, 2024 or until new contract(s) are executed, whichever occurs first, and increasing the contract amount by Two Million Seven Hundred Nineteen Thousand Thirty Five-Dollars and Zero Cents ($2,719,035.00) for a new total amount not to exceed Fifteen Million Three Hundred Sixty-Three Thousand Six Hundred Seventy Dollars and Zero Cents ($15,363,670.00).

 

2.                     The extension of Emergency Contract #E2023-08 is ratified from August 30, 2024 to the date of adoption of this authorizing Resolution until November 30, 2024 or until new contract(s) are executed, whichever occurs first.

 

3.                     Additional funds are available for Emergency Contract #E2023-08 in an amount not to exceed Two Million Seven Hundred Nineteen Thousand Thirty-Five Dollars and Zero Cents ($2,719,035.00) under line appropriation of the Official Budget, which shall be charged as:

                     Unclassified Budget - Fund: 011, 200, 2001, Account: 97550

                     Edison Land Swap - Fund: 026, Account: 32100

4.                     The Qualified Purchasing Agent, for the City of Newark, has filed a copy of Emergency Contract #E2023-08, attached hereto, with the Office of the City Clerk.

 

5.                     If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
