WHEREAS, the Police Department’s Prisoner Processing Division houses at least 50 prisoners a day, and prisoners in custody must be provided a meal in accordance with municipal guidelines of Department of Corrections; and
WHEREAS, on November 5, 2015, the City’s Director of Purchasing invoked the emergency purchasing procedure to award Emergency Contract E2015-13 to Dale Consumables, LLC, dba as Queen Pizza, 938 Broad Street, Newark, New Jersey, 07102, to provide meal delivery services for prisoners in the custody of the Newark Police Department, for the term of August 15, 2015 through November 14, 2015, in the amount of $33,000.00 (said Emergency Contract Award is attached hereto and made a part hereof); and
WHEREAS, pursuant to N.J.A.C 5:34-6.1(a), notwithstanding a good faith effort by the contracting unit to award a contract by having put it out for public bid, that process has not yet been completed, and an immediate need has arisen for an extension of the emergency contract for the delivery of prisoner meals for the period of November 15, 2015, through February 12, 2016, in order to protect the health, safety and welfare of the prisoner population; and
WHEREAS, this extension is authorized as per provisions under City Ordinance 6PSF-e, adopted April 6, 2011, and the emergency purchasing provisions pursuant to N.J.S.A. 40A:11-6; and
WHEREAS, the cost of supplying the prisoner meals for the period of November 15, 2015 through February 12, 2016, will not exceed $12,000.00; and
WHEREAS, the Director of the Newark Police Department recommends that an extension, as described above, of Emergency Contract E2015-13 be authorized and ratified.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Newark Police Department, are hereby authorized to extend Emergency Contract E2015-13 with Dale Consumables, L.L.C., dba Queen Pizza, 938 Broad Street, Newark, New Jersey 07102, to provide meal delivery services to prisoners at the Newark Police Department, Prisoner Processing Division, 31 Green Street, Newark, New Jersey 07102, for the term beginning on November 15, 2015 and ending on February 12, 2016, or until such time as the emergency condition may be abated by the award of a non-emergent replacement contract, whichever occurs first.
2. The extension of Emergency Contract E2015-13 is hereby ratified from November 15, 2015 to the date of adoption of this authorizing resolution.
3. The total cost of the extension of Emergency Contract E2015-13 shall not exceed $12,000.00.
4. Attached hereto is a budget detail document which shows that there are sufficient funds for the purpose set forth herein above in the following Funding Source: Business Unit: NW011, Fund Code: 011, Account#: 72020, Budget Year: 2015.
STATEMENT
This resolution ratifies and authorizes the Mayor and/or his designee, the Police Director, to extend Emergency Contract E2015-13 with Dale Consumables, L.L.C., dba Queen Pizza, 938 Broad Street, Newark, New Jersey 07102, to provide meal delivery services to prisoners at the Newark Police Department, for the term beginning on November 15, 2015 and ending on February 12, 2016, or until such time as the emergency condition may be abated by the award of a non-emergent replacement contract, whichever occurs first, for a total cost not to exceed $12,000.00.
