WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) (which includes Federal Funding of $95,367.00, plus Supplemental Support Funding of $15,000.00) for the New Jersey Transportation Planning Authority, Inc. (“NJTPA”) FY2024 Sub-Regional Transportation Planning Program and no adequate provision has been made in the 2023 Temporary Budget for the aforesaid purpose; and N.J.S.A. 40A:4-20 provides for the creation of an emergency appropriation for the above-mentioned purpose; and
WHEREAS, by an award letter dated June 30, 2023, the City of Newark has been awarded funds from the NJTPA, in the amount of $110,367.00 (which includes Federal Funding of $95,367.00, plus Supplemental Support Funding $15,000.00), to be used for the FY2024 Sub-Regional Transportation Planning Program; and
WHEREAS, N.J.S.A 40A:4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2023 pursuant to N.J.S.A. 40A:4-20, including this resolution, total...$ 507,442,196.40.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
No less than two-thirds of all members are hereby affirmatively concurring:
1. An emergency appropriation be and the same is hereby made for the following classification:

2. Said emergency appropriation shall be provided for in the 2023 budget.
3. A copy of this resolution shall be filed with the Director of the Division of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This Resolution establishes the revenue and appropriation in the 2023 Municipal Budget in the amount of One Hundred Ten Thousand Three Hundred Sixty-Seven Dollars and Zero Cents ($110,367.00) (including Federal Funding of $95,367.00, and Supplemental Support Funding of $15,000.00) for the FY2024 Sub-Regional Transportation Planning Program. Funding has been provided by the North Jersey Transportation Planning Authority Inc. (NJTPA). The project period is July 1, 2023 through June 30, 2024.
