This Resolution modifies Agreement Modification No. 2 to Agreement #2022-DT-BLA-209 by extending the contract term from October 1, 2025 to October 1, 2026, at no additional cost.

WHEREAS, pursuant to Resolution 7R3-a 11/14/2022, the City of Newark (“City”) entered into a Cost Replacement Agreement (Agreement No. 2022-DT-BLA-209) (“Agreement”) with the New Jersey Department of Transportation (“NJDOT”) as a part of a sub-recipient grant from the Federal Highway Administration for the CR 508 Central Avenue Bridge Over City Subway Structure Preliminary Design Project (“Central Avenue Bridge Project”); and
WHEREAS, the initial term of said Agreement was April 14, 2023 to April 01, 2025; and
WHEREAS, pursuant to Resolution 7R3-a 05/22/2024, the City and the NJDOT entered into Agreement Modification No. 1 Agreement No. 2022-DT-BLA-209, extending the term of the Agreement to October 1, 2025; and
WHEREAS, on May 19, 2025 the City sent a letter to NJDOT (a copy of the letter is attached hereto and made part hereof) requesting a second time extension to complete the Central Avenue Bridge Project; and
WHEREAS, on September 3, 2025 the City received a letter (a copy of the authorization letter is attached hereto and made a part hereof) from NJDOT authorizing a further extension of the term of the Agreement to October 01, 2026; and
WHEREAS, the City wishes to enter into Agreement Modification No. 2 to Agreement No. 2022-DT-BLA-209 (a copy of which is attached hereto and made a part hereof), with the NJDOT, which further extends the termination date of the Agreement from October 1, 2025 to October 1, 2026.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to enter into with the New Jersey Department of Transportation (“NJDOT”) Agreement Modification No. 2 to Agreement No. 2022-DT-BLA-209 (“Agreement Modification #2), extending the term thereof from October 1, 2025 to October 1, 2026.
2. The Acting Director of the Department of Engineering shall file a fully executed copy of the Agreement Modification #2 in the Office of City Clerk.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, to enter into Agreement Modification #2 to Agreement 2022-DT-BLA-209 with the New Jersey Department of Transportation for the CR 508 Central Avenue Bridge Over NJ City Subway Structure - Preliminary Design Project, which will extend the contract term until October 1, 2026. No Municipal funds are required or receipt or acceptance of this grant extension.
