Resolution 7R12-a adopted on August 2, 2017, awarded a contract in an amount not to exceed $486,580.00, upon the issuance of a written Notice to Proceed, until the completion of Project Construction, pursuant to N.J.S.A. 40A: 11-15(9).
This Amendment #1 will increase the contract amount by $479,227.00 for a new total contract amount not to exceed $965,807.00.

WHEREAS, Resolution 7R12-a adopted on August 2, 2017, authorized the Director of the Department of Water and Sewer Utilities to execute a contract with Suburban Consulting Engineers, Inc., 96 U.S. Highway 206, Suite 101, Flanders, New Jersey 07836, pursuant to a fair and open process, to provide Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, in an amount not to exceed $486,580.00, for a contract term until completion of project construction pursuant to N.J.S.A. 40A:11-15(9); and
WHEREAS, the City of Newark originally engaged in the Rehabilitation of Pequannock Aqueducts and Constructions Inspection. The initial goal of the inspection was to assess the operation of the air and cross-over valves to protect the pipeline and allow proper operation of the aqueduct and access road improvement. This amendment will cover Suburban Consulting Engineers, Inc. to perform project recommencement, State IA Cultural Resource Investigation, and perform the remaining work in accordance with updated rate table which includes scope of services; and
WHEREAS, the Department of Water and Sewer Utilities wishes to execute Amendment #1 with Suburban Consulting Engineers, Inc., 96 U.S. Highway 206, Suite 101, Flanders, New Jersey 07836, to continue providing Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, for an additional $479,227.00, for a total contract amount not to exceed $965,807.00, until completion of project construction pursuant to N.J.S.A. 40A:11-15(9). The amendment scope of services are detailed in the attached Suburban Consulting Engineers, Inc. letter dated November 17, 2023 attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to enter into and execute Amendment #1, with Suburban Consulting Engineers, Inc., 96 U.S. Highway 206, Suite 101, Flanders, New Jersey 07836, to continue to provide Professional Engineering Services for the Rehabilitation of Pequannock Aqueducts and Construction Inspection, as set forth in the agreement and detailed in Suburban Consulting Engineers, Inc. proposal for an additional $479,227.00, and a total contract amount not to exceed $965,807.00, until completion of project construction pursuant to N.J.S.A. 40A:11-15(9).
2. Amendment #1 is ratified from the date of the commencement of the additional work to the date of adoption of this authorizing resolution.
3. Attached hereto is a Certificate of Funds from the Director of Finance of the City of Newark which states that there are sufficient funds, in the amount of Four Hundred Seventy Nine Thousand Two Hundred Twenty Seven Dollar and zero cent ($479,227.00), from the Department of Water and Sewer Utilities/NW041-23W-23W00-94710-B2023 for the purpose set forth herein. The Certification of Funds shall be filed along with the original resolution in the Office of the City Clerk.
4. The Director of the Department of Water and Sewer Utilities shall forthwith file a duly executed copy of the amended contract in the Office of the City Clerk.
5. There shall be no amendment or change to the contract without approval by the Newark Municipal Council.
6. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of its passage.
