                     WHEREAS, the City of Newark, Department of Water and Sewer Utilities, requires the services of qualified contractors to provide Maintenance and Repair for Integrator Services for Newark’s Water and Wastewater System; and

WHEREAS, the Department of Water and Sewer Utilities owns and operates the largest public water system in New Jersey, as well as an extensive wastewater collection network spanning multiple counties, necessitating the continuous, safe, and efficient operation of critical instrumentation, control, and Supervisory Control and Data Acquisition (SCADA) systems; and

WHEREAS, in order to maintain uninterrupted service, protect public health, and ensure compliance with all applicable safety and regulatory standards, it is essential for the City to engage an experienced systems integrator to perform scheduled and emergency maintenance, repairs, and technical support for instrumentation, controls, and related electromechanical and computer-based equipment; and

WHEREAS, pursuant to the public bidding process of the Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq., on September 16, 2025, the Department of Water and Sewer Utilities, advertised in a general circulation paper, for the receipt of sealed bids for the Maintenance and Repair for Integrator Services for Newark’s Water and Wastewater System; and

 

WHEREAS, four (4) prospective bidders requested Bid Specifications from the Department of Water and Sewer Utilities; and

 

WHEREAS, on October 2, 2025, the Department of Water and Sewer Utilities received sealed bids from three (3) contractors for Maintenance and Repair for Integrator Services for Newark’s Water and Wastewater System; and

 

WHEREAS, upon review and evaluation of the submitted bids, the Department determined that the bid submitted by Innovative Mission Systems did not include the required bid bond as stipulated in the bid specifications, and was therefore deemed non-responsive in accordance with the New Jersey Local Public Contracts Law, N.J.S.A. 40A:11-1 et seq.; and

 

WHEREAS, after careful review and analysis of the remaining bids, the Department of Water and Sewer Utilities determined that PCS Pump and Process, located at 41 Plymouth Street, Fairfield, New Jersey 07004, and Pumping Services, Inc., located at 201 Lincoln Boulevard, Middlesex, New Jersey 08846, met all bid requirements and submitted the lowest responsive and responsible bids; and

 

WHEREAS, the Department of Water and Sewer Utilities reviewed the bids and confirmed that the objectives of competitive bidding were achieved, favorable bid prices were received, both contractors are capable of executing the work in accordance with the bid specifications and the Department recommends that a multiple award be made; and

 

WHEREAS, the Department of Water and Sewer Utilities desires to award contracts to both PCS Pump and Process and Pumping Services, Inc., for the Maintenance and Repair of Integrator Services for Newark’s Water & Wastewater System, for a total amount not to exceed Six Hundred Thousand Dollars ($600,000.00) for both contractors, for a period of two (2) years from the issuance of a Notice to Proceed. and

 

                                                     WHEREAS, pursuant to N.J.S.A. 19:44A-20.5 et seq., solicitations through public bidding in accordance with N.J.S.A. 40A:11-1, et seq., meets the requirements of a Fair and Open Process.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee the Director of the Department of Waterand Sewer Utilities, are authorized to  enter into and execute a contract with: (1) PCS Pump and Process., 41 Plymouth Street, Fairfield, New Jersey, 071104; and (2) Pumping Services, Inc., 201 Lincoln Blvd, Middlesex, New Jersey, 08846  to perform Maintenance and Repair of Integrator Services for Newark’s Water & Wastewater System for a total amount not to exceed Six Hundred Thousand Dollars and Zero Cents ($600,000.00), for both contractors for a period of two (2) years commencing upon the issuance of a Notice to Proceed by the Department of Water and Sewer Utilities

 

2.                     Pursuant to N.J.A.C. 5:30-5.5(a), Temporary Budget, attached hereto is the Chief Finance Officer’s Certification, which states partial funds in the amount of $10,000.00, are available in the Department of Water and Sewer Utilities Budget under Business Unit NW037, Department ID 750, Division 7502, Account 71770 B2025 and NW038-800-8003-71770 B2025

a.                     the balance to be provided in the 2025, 2026 and 2027 Adopted Budgets. The Certification shall be filed, along with the original resolution and the executed contract in the Office of the City Clerk.  This is an open-end contract to be used as needed during the term of the contract. Thus, for any and all expenditures against this contract, a certification of the availability of sufficient funds, as required by N.J.A.C. 5:30-5.5(b)(2), shall be executed. 

 

3.                     There shall be no amendment or change to the contract without approval by the Municipal Council.

 

4.                     There shall be no advance payment on this contract in accordance with N.J.S.A. 40A:5-16.

 

5.                     The Department of Water and Sewer Utilities shall file a fully executed copy of the contract and Notice to Proceed in the Office of the City Clerk.

 

6.                     If required by State Law, the City Clerk shall provide the appropriate Notice of the Award of this contract to the State Comptroller no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.    

 

 

STATEMENT             

 

This Resolution authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to execute contracts with two contractors (1) PCS Pump and Process; and (2) Pumping Services, Inc. for the purpose of providing Maintenance and Repair of Integrator Services for Newark’s Water & Wastewater System, for a total combined amount not to exceed $600,000.00 for both contractors. These contracts will be in effect for a period of two (2) years from the date of issuance of a Notice to Proceed.
