WHEREAS, on September 26, 2016, Emergency Contract #E2016-14 was entered into to provide solid waste removal services with Interstate Waste Services, Inc., 300 Frank W. Burr Boulevard, Suite 39, Teaneck, New Jersey 07666, from June 12, 2016 through September 13, 2016, in the amount of Five Hundred Thousand Dollars and Zero Cents ($500,000.00) (a copy of said Emergency Contract #E2016-14 is attached hereto and made a part hereof); and
WHEREAS, the City of Newark advertised for bids for these solid waste removal services, which are due back to the City on March 21, 2017; and
WHEREAS, The Department of Public Works, formerly known as the Department of Neighborhood and Recreational Services, requests an extension of the emergency contract with Interstate Waste Services, Inc., 300 Frank W. Burr Boulevard, Suite 39, Teaneck, New Jersey 07666; to continue providing solid waste removal services until they can award a new contract; and
WHEREAS, the areas of solid waste removal is for the South Ward and a portion of the Central Ward; and.
WHEREAS, it is imperative that we sweep our streets; not doing so will promote unsanitary living conditions and filthy streets, affecting the health, safety, and welfare of the citizens of Newark; and
WHEREAS, the cost for solid waste removal is $156,598.00 monthly and for seven (7) months will total $1,096,186.00; and
WHEREAS, pursuant to N.J.A.C 5:34-6.1(a), notwithstanding a good faith effort by the contracting unit to award a contract, the need has arisen for an emergency contract for street solid waste removal, all wards; and
WHEREAS, City Ordinance 6PSF-e adopted April 6, 2011, Article 2:5-13.2(E)(1)(b), states that Emergency Contracts shall not be for a period in excess of three (3) months and no extensions of emergency contracts shall be permitted without authorization by the Municipal Council by resolution; and
WHEREAS, N.J.A.C. 5:30:5-5(a) provides that municipalities may enter into contracts without a full Certification of Funds when the municipality is operating under a temporary budget, and the City of Newark is, in fact, currently operating under a temporary budget; and
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator and the Director of Public Works, formerly known as the Director of Neighborhood and Recreational Services, are hereby authorized to execute an extension of Emergency Contract #E2016-14 with Interstate Waste Services, Inc. 300 Frank W. Burr Boulevard, Suite 39, Teaneck, New Jersey 07666, to continue providing solid waste removal services, for the South Ward and a portion of the Central Ward at a cost of $156,598.00 per month for seven (7) months, total cost not to exceed $1,096,186.00, from September 14, 2016 through April 13, 2017; or until a contract is awarded, but in no event later than December 31, 2017.
2. The above-described extension of emergency contract resolution is hereby ratified from September 14, 2016 to the date of adoption of this authorizing resolution.
3. Pursuant to N.J.A.C. 5:30-5(a), a Temporary Budget, attached hereto is a partial Certifications of Funds from the Director of Finance of the City of Newark, indicating that there are sufficient funds available for all liability to be incurred during the City of Newark’s temporary budget period, more specifically: [i] Certification of Funds in the amount of $50,000.00, Business Unit NW011, Department 060, Division/Project 0605, Account# 71940 for fiscal year B2017.
4. The continuation of Emergency Contract #E2016-14 beyond the City of Newark’s temporary budget period is subject to the appropriation of sufficient funds.
5. Immediately after the City of Newark adopts its final budget, a Certification of Funds shall be prepared for the remaining balance and filed by the Business Administrator on behalf of the Department of Health and Community Wellness with the original resolution in the Office of the City Clerk.
6. Copies of this resolution and the above-described extended Emergency Contract shall be filed with the Office of the City Clerk, by the Business Administrator on behalf of the Department of Health and Community Wellness.
STATEMENT
