WHEREAS, the City of Newark (Newark), having tax identification number 226002138, hereby elects to participate in the Health Program provided by the New Jersey State Health Benefits Act of the State of New Jersey (N.J.S.A. 52:14-17.26 and N.J.S.A. 52:14-17.46.2) and to authorize coverage for all the employees and their dependents thereunder in accordance with the statute and regulations adopted by the State Health Benefits Commission; and

 

WHEREAS, Newark elects to participate in the Employee Prescription Drug Plan defined by N.J.S.A. 52:14-17.25 et seq. and authorize coverage for all employees and their dependents in accordance with the statute and regulations adopted by the State Health Benefits Commission; and

 

WHEREAS, Newark will maintain Horizon as its dental plan; and

 

WHEREAS, Newark elects 35 hours per week (average) as the minimum requirement for full time status in accordance with N.J.A.C. 17:9-4.6; and

 

WHEREAS, as a participating employer Newark will remit to the State Treasury all charges due on account of employee and dependent coverage and periodic charges in accordance with the requirements of the statute and the rules and regulations duly promulgated thereunder; and

 

WHEREAS, Newark hereby appoints Kecia Daniels, Esq., Director of Personnel, to act as Certifying Officer in the administration of this program; and

 

WHEREAS, this resolution shall take effect immediately and coverage shall be effective as of May 1, 2017 or as soon thereafter as it may be effectuated pursuant to the statutes and regulations (can be no less than 75 or 90 days pursuant to the provisions of N.J.S.A. 17:9-1.4).

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee the Business Administrator and/or the Director of the Division of Personnel are authorized to prepare and execute all necessary and required documents for the City of Newark’s employees and dependents to participate in the State Health Benefits Program. 

 

2.                     Upon adoption of this authorizing resolution, the City Clerk is authorized to certify on the State’s mandatory form Resolution HB-0077-1213, as completed and  attached to this authorizing Resolution as being a true and correct copy of a resolution being duly adopted by the Municipal Council.

 

3.                     The Mayor and/or his designee the Business Administrator and/or the Director of the Division of Personnel are authorized to terminate existing contracts, when appropriate, so there is no lapse in coverage with the health benefit providers for City of Newark’s employees and dependents. 

 

4.                       A copy of all documents shall be filed with the Office of the City Clerk by the Director of the Division of Personnel.

Resolution authorizing the Mayor and/or his designee the Business Administrator and/or the Director of the Division of Personnel to execute all necessary and required documents for the City of Newark’s employees and dependents to participate in the State Health Benefits Program.
