WHEREAS, On February 22, 2019 the Municipal Council adopted Resolution 7R3-A, authorizing the Mayor and/or his designee, the Director of the Department of Engineering, to enter into a Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON; and
WHEREAS, On April 5, 2019, the NJDOT informed the City of Newark that the Cost Reimbursement Agreement Document had changed format on February 22, 2019, and the one authorized previously was no longer valid; and
WHEREAS, the City of Newark seeks to amend Resolution 7R3-A, adopted February 22, 2019, to authorize the Mayor and/or his designee, the Director of the Department of Engineering, to enter into the revised formatted Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON, instead of the form Cost Reimbursement Agreement authorized by Resolution 7R3-A.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. Resolution 7R3-A, adopted February 22, 2019, is hereby amended to authorize the Mayor and/or his designee, the Director of the Department of Engineering, on behalf of the City of Newark, to enter into a revised formatted Cost Reimbursement Agreement No. 2018-DT-BLA-212, termed Federal Aid Agreement, with New Jersey Department of Transportation, Division of Local Aid and Economic Development (NJDOT), for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON instead of the form Cost Reimbursement Agreement authorized by Resolution 7R3-A adopted February 22, 2019.
2. This resolution is hereby ratified from February 22, 2019, until the date of adoption of this authorizing resolution.
3. No municipal funds are required for receipt or acceptance of this grant award.
4. The Mayor and/or his designee, the Director of the Department of Engineering, are hereby authorized on behalf of the City of Newark to solicit proposals/receive bids to accomplish the objectives outlined in the revised formatted Cost Reimbursement Agreement No. 2018-DT-BLA-212 for the Dr. Martin Luther King, Jr. Boulevard Pedestrian Safety Corridor Improvements HSP-1904(300)CON.
5. No work shall commence prior to the receipt and budget insertion of the grant funds from the New Jersey Department of Transportation.
6. The Director of the Department of Engineering shall file a fully-executed copy of the Cost Reimbursement Agreement No. 2018-DT-BLA-212 in the Office of the City Clerk.
