WHEREAS, the Department of Health and Community Wellness provides medical care services pursuant to and consistent with Health Care Program Statutes (Section 330 of Public Health Services Act: 42 U.S.C. Section 254b), Program Regulation (43 CFR part 51 and 42 CFR 56.201) for Community and Migrant Health Centers and Grant Regulations (42 CFR part 74), Affordable Health Care Act (42 U.S.C.A. § 18001 et. seq.); and
WHEREAS, the United States Department of Health and Human Services/Health Resources and Services Administration has made grant funds available for the provision of said medical care services; and
WHEREAS, on August 16, 2017, on behalf of the City of Newark, the Director of the Department of Health and Community Wellness electronically filed an application to the United States Department of Health and Human Services/Health Resources and Services Administration, Hubert H. Humphrey Building, 200 Independence Avenue, S.W, Washington, D.C. 20201, requesting grant funding in the amount of Three Million, Four Hundred Eleven Thousand, Two Hundred Ninety-Seven Dollars and Zero Cents ($3,411,297.00), for the continued provision of health care services to the medically underserved populations in the City of Newark and its surrounding areas (a copy of the application is attached hereto and made a part hereof); and
WHEREAS, as a result of this application, the City of Newark was awarded a grant on November 28, 2017, in the amount of Three Million, Four Hundred Thirty-Nine Thousand, Six Hundred Ninety-Seven Dollars and Zero Cents ($3,439,697.00), from the United States Department of Health and Human Services/Health Resources and Services Administration for the continued provision of health care services to the medically underserved populations in the City of Newark and its surrounding areas, for the budget period of January 1, 2018 through December 31, 2018 (a copy of the Notice of Award is attached hereto and made a part hereof); and
WHEREAS, the Director of the Department of Health and Community Wellness did subsequently, on behalf of the City of Newark, cause the appropriate electronic submission to be filed that was necessary to accept the above-mentioned grant award; and
WHEREAS, the City of Newark recognizes that the United States Department of Health and Human Services/Health Resources and Services Administration may extend the time of the grant award and/or provide additional funds if made available; and
WHEREAS, the United States Department of Health and Human Services/Health Resources and Services Administration may amend the grant to reflect the grant time extension and/or increase or decrease of funds; and
WHEREAS, the City of Newark, Department of Health and Community Wellness, shall, upon any such extension of time of the grant and/or increase or decrease of grant funds, submit to the Newark Municipal Council for its consideration a proposed form of amending resolution reflecting the final term and award amount of the grant; and
WHEREAS, terms of this grant award may only be waived or amended by the parties duly authorized to execute the grant, subject to the approval of the Newark Municipal Council by resolution.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to submit an application to the United States Department of Health and Human Services/Health Resources and Services Administration, Hubert H. Humphrey Building, 200 Independence Avenue, S.W., Washington, D.C. 20201, requesting funding in the amount of Three Million, Four Hundred Eleven Thousand, Two Hundred Ninety-Seven Dollars and Zero Cents ($3,411,297.00), for the continued provision of health care services to medically underserved populated areas, which includes the City of Newark.
2. The Municipal Council hereby ratifies its authorization of this application from the date of application submission to the date of adoption of this authorizing resolution.
3. The resulting grant award in the amount of Three Million, Four Hundred Thirty-Nine Thousand, Six Hundred Ninety-Seven Dollars and Zero Cents ($3,439,697.00), from the United States Department of Health and Human Services/Health Resources and Services Administration is hereby accepted.
4. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to file the electronic acceptance necessary to accept the grant award.
5. The Municipal Council hereby ratifies the acceptance of this grant award from the date the electronic acceptance was filed to the date of adoption of this authorizing resolution.
6. The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, are hereby authorized to receive and expend the grant award for the continued provision of health care services to the medically underserved populated areas which includes the City of Newark for the period of January 1, 2018 through December 31, 2018.
7. The City of Newark, Department of Health and Community Wellness, shall upon any extension of time of the grant and/or increase or decrease of additional funds, submit to the Newark Municipal Council for its consideration a proposed form of amending resolution reflecting the final time and award amount of the grant.
8. No municipal matching funds are required for the receipt or acceptance of this grant award.
9. The Director of the Department of Health and Community Wellness shall file in the Office of the City Clerk a fully executed copy of the grant application and the associated Notice of Award.
STATEMENT
This resolution hereby ratifies and authorizes the actions taken by the Mayor and/or his designee, the Director of Health and Community Wellness, to apply for and accept grant funds in the amount of Three Million, Four Hundred Thirty-Nine Thousand, Six Hundred Ninety-Seven Dollars and Zero Cents ($3,439,697.00), from the United States Department of Health and Human Services/Health Resources and Services Administration, for the continued provision of health care services to medically underserved populations in the City of Newark and its surrounding areas, for the period of January 1, 2018 through December 31, 2018. No municipal matching funds are required for the receipt or acceptance of the grant funds.
