                     WHEREAS, the Hispanic Law Enforcement Society of Essex County, who have many members working in the City of Newark’s Police Division, along with other members of the City’s Department of Public Safety, developed a relief program by which they arranged for the delivery of desperately needed essential supplies to the residents of Puerto Rico, which was devastated by Hurricane Maria on or about September 22, 2017 (a list of those supplies being delivered is attached hereto); and

 

                     WHEREAS, part of the relief program involves the donation of eight (8) seats aboard a flight from Newark Airport to San Juan, Puerto Rico, and cargo space on that same flight adequate in size to accommodate fourteen (14) or more pallets (the “Gift”), by United Airlines, Inc., 233 S. Wacker Drive, Chicago, IL 60606 (“United”), the value of which is estimated to be $17,503.81; and

 

                     WHEREAS, the Administration of the City of Newark is proud of those members of the Newark Department of Public Safety who are participating in the relief program, and the City wishes to cooperate with and support the relief program to the extent that it is reasonable to do so; and

 

                     WHEREAS, United advised that United can only donate the Gift, if the City’s Acting Corporation Counsel executes a letter which simply formalizes the City’s acceptance of United’s gift, and acknowledges the parties’ understanding that the Gift is not being made in exchange for any governmental action involving United (a copy of the letter is attached) (the “Letter”); and

 

                     WHEREAS, the City’s Acting Corporation Counsel has reviewed the Letter, and has no objection to its execution; and

 

                     WHEREAS, the City’s Business Administrator and Acting Director of Public Safety therefore recommend that the Newark Municipal Council adopt this Resolution accepting the Gift and authorizing the City’s Acting Corporation Counsel to execute the Letter.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor, Business Administrator, and/or Director of Public Safety are hereby authorized to accept from United Airlines, Inc., 233 S. Wacker Drive, Chicago, Illinois 60606, the gift of the donation of roundtrip tickets for eight (8) seats aboard a flight from Newark Airport to San Juan, Puerto Rico, and cargo space on that same flight adequate in size to accommodate fourteen (14) or more pallets, valued at approximately $17,503.81, and furthermore, the City of Newark’s Acting Corporation Counsel is hereby authorized to issue the Letter requested by United.

 

2.                     The Municipal Council ratifies the acceptance of the Gift and the execution of the Letter from approximately October 16, 2017, to the date of the adoption of this authorizing resolution.

 

3.                     No municipal funds will be expended in the acceptance of this Gift.

 

4.                     The original executed Letter to United shall be filed in the Office of the City Clerk by the Acting Corporation Counsel.

 

STATEMENT

 

This Resolution ratifies and authorizes the actions taken by the Mayor and/or his designees, the Business Administrator, the Acting Public Safety Director and/or the Acting Corporation Counsel, to accept a gift from United Airlines, Inc., 233 S. Wacker Drive, Chicago, Illinois 60606, of roundtrip tickets for eight (8) seats aboard a flight from Newark Airport to San Juan, Puerto Rico, and cargo space on that same flight adequate in size to accommodate fourteen (14) or more pallets, valued at approximately $17,503.81 and further authorizes the Acting Corporation Counsel to enter into and execute a letter to United which formalizes the City’s acceptance of the gift.
