                     WHEREAS, the City of Newark owns and operates a Rock Salt storage and dispensing facility for its own needs; and

 

                                          WHEREAS, the Newark Public School District is desirous of making use of the Rock Salt storage and dispensing facility owned by the City of Newark located at 62 Frelinghuysen Avenue, Newark, New Jersey; and

                                           

                     WHEREAS, pursuant to Resolution 7R10-B, adopted November 22, 2010 (a copy of which is attached hereto and made a part hereof), the City of Newark authorized the creation of the Newark Commodity Resale System, with the City serving as the Lead Agency, which authorized the resale of Sodium Chloride (Rock Salt - Bulk) by the City of Newark to the Newark Public School District; and

 

                     WHEREAS, pursuant to said Resolution, on or about November 1, 2012, the City of Newark and the Newark Public School District did, in fact, enter into a Commodity Resale Agreement for the resale of Sodium Chloride (Rock Salt - Bulk) by the City of Newark to the Newark Public School District; and

 

                     WHEREAS, said Agreement expired on or about March 31, 2014; and

 

                     WHEREAS, the City of Newark desires to enter into a new Commodity Resale Agreement with the Newark Public School District for the resale of Sodium Chloride (Rock Salt - Bulk), with a term beginning on November 1, 2014, and ending on March 31, 2018

 

                     NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

                     1.  The Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, are hereby authorized to enter into a Commodity Resale Agreement (in the form of agreement attached hereto) with the Newark Public School District for the resale of Sodium Chloride (Rock Salt - Bulk) at an initial price of $48.87 per ton, but which may be increased based on market rate, subject to the continued registration of the Newark Commodity Resale System with, and approval by, the Director of the Division of Local Government Services.

 

                     2.  The term of said Commodity Resale Agreement shall begin on November 1, 2014, and end on March 31, 2018.

 

                     3.  This authorization is hereby ratified from November 1, 2014, to the date of adoption of this authorizing resolution.

 

4.  A certified copy of this Resolution and the Commodity Resale Agreement shall be forwarded to the Director of the Division of Local Government Services within the State Department of Community Affairs, along with whatever documentation may be needed, if any, to ensure the continued registration of the Newark Commodity Resale System.

 

                     5.  A fully-executed copy of the Commodity Resale Agreement, a copy of a filed Request for Registration as may be necessary and a copy of the State Director’s approval shall be filed with the Office of the City Clerk by the Director of the Department of Neighborhood and Recreational Services.

 

STATEMENT

 

                     This resolution ratifies and authorizes the Mayor and/or his designee, the Director of the Department of Neighborhood and Recreational Services, to enter into a Commodity Resale Agreement with the Newark Public School District for the sale of Sodium Chloride (Rock Salt-Bulk) at an initial price of $48.87 per ton, which may be increased based on market rate, for the period commencing November 1, 2014 and terminating on March 31, 2018.
