Emergency Contract #E2025-07, covering the period of March 31, 2025 through June 30, 2025, was awarded at the request of the Department of Public Safety, in an amount not to exceed $525,100.00. This extension shall be in effect for an additional (90) days.

WHEREAS, on March 31, 2025, the Department of Public Safety requested a declaration of emergency for immediate reconstruction of the floor bays that house fire apparatus Engine 5, located at 65 Congress Street, which among others has been the subject of Public Employees Occupational Safety and Health (PEOSH) violations, due to signs of appalling concrete and holes, cracks on structural columns and beams supporting the bay floors, potentially affecting firefighting operational readiness; and
WHEREAS, based on the above request, on April 1, 2025, the Purchasing Agent issued an emergency contract to Power Concrete Co., Inc. 497 Raymond Boulevard Newark, NJ 07105 (“contractor”), in an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00) with; and
WHEREAS, on June 30, 2025, the Public Safety Department requested an extension of Emergency Contract #E2025-07 for an additional (90) days after uncovering existing conditions necessitating a significant redesign of the original construction documents; and
WHEREAS, N.J.S.A. 40A:11-6 provides that emergency contracts may be entered into when situations affecting the health, public safety and welfare or residents arise; and
WHEREAS, City Ordinance 6PSF-e adopted on April 6, 2011, Article 2:5-13.2 (E)(1)(b) and (c) limits the period of emergency contracts to ninety (90) days and precludes extensions of emergency contracts without authorization by the Municipal Council by Resolution; and
WHEREAS, the Department of Public Safety now seeks ratification and authorization by the Municipal Council of Emergency Contract #E2025-07 to continue the reconstruction of the floor bays that house fire apparatus Engine 5.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designees, the Business Administrator, and/or the Purchasing Agent, QPA, are hereby authorized to execute an extension of Emergency Contract #E2025-07, awarded to Power Concrete Co., Inc., 497 Raymond Boulevard Newark NJ, 07105, for reconstruction of the floor bays that house Fire Apparatus Engine 5 in an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00), which is the amount of the initial contract award.
2. The extension of Emergency Contract #E2025-07 is hereby authorized for the period July 1, 2025, to September 30, 2025. This authorization is ratified back to July 1, 2025.
3. Funds for this contract are available under account code NW051-G25-F25D0-72090-B2025
4. The Qualified Purchasing Agent shall file copies of all documents related to Emergency Contract #E2025-07 with the Office of the City Clerk, and pursuant to section 2:5-13.2 of the City Code also post it on the City’s website within forty-eight (48) hours.
5. If required by State Law, the City Clerk shall provide the appropriate notice of the award of this contract to the State Comptroller, no later than twenty (20) business days following such award, in accordance with N.J.S.A. 52:15C-10 and the Notice of the Office of the State Comptroller dated May 7, 2008.
STATEMENT
This Resolution ratifies and authorizes the Mayor, and/or his designees, the Business Administrator and/or the Purchasing Agent, QPA, to extend Emergency Contract #E2025-07 with Power Concrete Co., Inc. 497 Raymond Boulevard Newark NJ, 07105, in an amount not to exceed Five Hundred Twenty-Five Thousand One Hundred Dollars and Zero Cents ($525,100.00). The emergency extension does not increase the amount of the initial contract award.
