WHEREAS, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, will operate the Women’s Basketball Showcase for approximately Two Hundred (200) City of Newark residents, ages eighteen (18) and over, as a recreational and physical activity program; and
WHEREAS, the Women’s Basketball Showcase will operate on May 20, 2017, from 3:00 p.m. to 8:00 p.m.; and
WHEREAS, based upon the capacity and facility needs of the Women’s Basketball Showcase, and the programs already scheduled to be conducted at the City of Newark recreational facilities with regulation size basketball courts, Newark Housing Authority’s The Waterfront gymnasium facility is required for the operation of the basketball showcase on May 20, 2017; and
WHEREAS, this year, the City of Newark, Department of Recreation, Cultural Affairs and Senior Services, desires to operate the Women’s Basketball Showcase at Newark Housing Authority’s The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104; and
WHEREAS, in order to operate the Women’s Basketball Showcase at The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, the City of Newark is required to issue a Hold Harmless and Indemnification Agreement, agreeing to hold harmless, indemnify, and defend the Newark Housing Authority, its agents, servants and administrators from any and all liability arising out of or related to the use of said premises or property, including but not limited to, any and all costs, including attorney fees; and
WHEREAS, in order to operate the Women’s Basketball Showcase at The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, the City of Newark is required to obtain a permit to operate from the Newark Housing Authority; and
WHEREAS, Newark Housing Authority is waiving the Permit Application fee for the City of Newark’s use of its facilities for the Women’s Basketball Showcase; and
WHEREAS, the Municipal Council of the City of Newark supports the Women’s Basketball Showcase by supporting its efforts to obtain a permit to operate the program at The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104; and approving that the City of Newark issues a Hold Harmless and Indemnification Agreement with the Newark Housing Authority.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Municipal Council of the City of Newark supports the City of Newark’s obtainment of a permit to operate the Women’s Basketball Showcase at The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, on May 20, 2017, from 3:00 p.m. to 8:00 p.m.
2. The Municipal Council of the City of Newark, in furtherance of obtaining the above referenced permit for the stated purpose, supports issuance of a Hold Harmless and Indemnification Agreement agreeing to hold harmless, indemnify, and defend the Newark Housing Authority, its agents, servants and administrators from any and all liability arising out of or related to the use of said premises or property, including but not limited to, any and all costs, including attorney fees.
3. The Director of Recreation, Cultural Affairs and Senior Services shall forward to the Newark Housing Authority’s, The Waterfront Center Manager, M. Reed, 2 Grafton Avenue, Newark, New Jersey 07104, copies of the Hold Harmless and Indemnification Agreement inuring to the benefit of Newark Housing Authority.
4. The Director of Recreation, Cultural Affairs and Senior Services shall file in the Office of the City Clerk, the duly executed copies of the Hold Harmless and Indemnification Agreement inuring to the benefit of Newark Housing Authority.
STATEMENT
This Resolution authorizes the City of Newark to obtain a permit to use The Waterfront, 2 Grafton Avenue, Newark, New Jersey 07104, for the Women’s Basketball Showcase, on May 20, 2017, from 3:00 p.m. to 8:00 p.m.; and supports the issuance of a Hold Harmless and Indemnification Agreement for, the Newark Housing Authority, 500 Broad St, Newark, New Jersey 07102, for said date and time.
