WHEREAS, the Department of Engineering is in need of professional architectural design and construction management and administration services for the Proposed Improvements to City-Owned Property Basement Unit located at 111 Mulberry Street, Newark, New Jersey 07102; and
WHEREAS, it is the intention of the City of Newark to utilize this space for an education and tutoring facility; and
WHEREAS, professional architectural design and related construction management and administration services are not required to be publicly bid, pursuant to the Local Public Contracts Law, N.J.S.A. 40A:11-5(a)(1)(i); and
WHEREAS, on July 12, 2012, the Department of Engineering advertised for the receipt of responses to a Request for Qualifications/Request for Proposals ("RFQ/RFP"), from qualified engineers and/or architects to provide those professional services for the City-Owned Property Basement Unit at 111 Mulberry Street, Newark, New Jersey 07102; and
WHEREAS, nineteen (19) consultants/firms obtained the RFP/RFQ specifications; and
WHEREAS, on July 31, 2012, seven (7) firms and individuals submitted qualification statements and cost proposal amounts; and
WHEREAS, after a review of the cost proposals, , the Director of the Department of Engineering has determined that Heritage Architecture, LLC, 352 Evelyn Street, Suite #2, Paramus, New Jersey 07052, has the requisite expertise and experience to address the needs of the City of Newark in a manner that is advantageous to the taxpayers, cost and other factors considered, and recommends an award of the professional service Contract #09-2012PS Proposed Improvements to City-Owned Property Basement Unit located at111 Mulberry Street, Newark, New Jersey 07102, to Heritage Architecture, LLC, which submitted the lowest, combined cost proposal ($19,000.00 for the design stage; and $13,300.00 for the construction management and administration stage), for a total amount not to exceed $32,300.00; and
WHEREAS, the award of this contract through an RFQ/RFP process, constitutes a fair and open process pursuant to the Local Unit Pay-to-Play Law, N.J.S.A. 19:44A-10.5 et seq and is in compliance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq; and
WHEREAS, this contract has been determined and certified in writing to have a value that exceeds $17,500.00; and
WHEREAS, the Mayor of the City of Newark signed into law Executive Order Number MEO-07-0001 (hereinafter "Pay-o-Play Executive Order"), which requires reporting of political contributions to Newark Municipal Candidates and prohibits certain political contributions during the duration of the contract; and
WHEREAS, Heritage Architecture, LLC, 352 Evelyn Street, Suite #2, Paramus, new Jersey 07052, has completed a City Political Disclosure Statement, the original of which shall be placed on file with the contract in the Office of the City Clerk.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee the Director of the Department of Engineering is hereby authorized on behalf of the City of Newark to execute a professional services Contract #09-2012PS Proposed Improvements to City-Owned Property Basement Unit located at 111 Mulberry Street, Newark, New Jersey 07102 ,with Heritage Architecture, LLC, 352 Evelyn Street, Suite #2, Paramus, New Jersey 07052, for an amount not to exceed $32,300.00.
2. Attached hereto is a certification of funds issued by the Chief Financial Officer, City of Newark, which states that there are available sufficient legally appropriated funds in the amount of $32,300.00 for the purposes set forth herein. A copy of the certification of funds shall be filed in the Office of the City Clerk by the Director of Engineering together with this resolution.
3. The term of this contract shall be one (1) year from the date of issuance of a formal "Notice to Proceed" by the Director of Engineering or his designee.
4. No amendments or modifications to this contract shall be allowed or authorized without prior Municipal Council approval.
5. There shall be no advance payments made against this contract in accordance with N.J.A.C. 40A:5-16.
6. A fully executed copy of the contract shall be filed in the Office of the City Clerk, by the Director of Engineering or his designee.
7. Heritage Architecture, LLC., 332 Evelyn Street, Suite #2, Paramus, New Jersey 07052, has certified that it has neither made nor will make a prohibited contribution in violation of any applicable federal or state laws, or City Ordinances, including but limited to the Executive Order on Pay-to-Play Reform (MEO-7-0001) as may be amended from time to time. Any such failure shall constitute a breach of the Contract.
8. A notice of this action shall be printed in a local newspaper as required by law within ten (10) days hereof.
9. Funds for this contract in the amount of $32,300.00 is provided from Fund: 026, Department: BS, Account: 3210, Budget Year: B2012
STATEMENT
This resolution authorizes the Mayor and/or his designee and the Director of the Department of Engineering, to execute a professional services Contract #09-2012PS Proposed Improvements to City-Owned Property Basement Unit located at 111 Mulberry Street, Newark, New Jersey 07102 with Heritage Architecture, LLC, 352 Evelyn Street, Suite #2, Paramus, New Jersey 07052, for an amount not to exceed $32,300.00, for a period of one (1) year from the issuance of a formal written Notice to Proceed by the Director of the Department of Engineering.
