WHEREAS, the State of New Jersey Department of Transportation (“NJDOT”) FY 2024 Transit Village Grant Program provides municipalities with grant funding for transportation improvements; and
WHEREAS, on July 1, 2023, on behalf of the City of Newark (“City”), the Acting Director of the Department of Engineering (“Director”) submitted an application to NJDOT requesting grant funding from the NJDOT FY 2024 Transit Village Grant Program for construction of the Newark Transit Village Pedestrian Safety Improvement Project (“Project”); and
WHEREAS, on July 11, 2023, the Municipal Council adopted Resolution 7R3-C(s) ratifying said application and authorizing the acceptance, receipt and expenditure of said grant funding; and
WHEREAS, on November 30, 2023, NJDOT announced that the City was selected to receive a grant award in the amount of Five Hundred Sixteen Thousand Dollars and Zero Cents ($516,000.00) for the construction of the Project; and
WHEREAS, NJDOT requires the City to award the contract for the construction of the Project within two (2) years of the grant award notification, which, by letter dated May 30, 2025, the NJDOT has indicated is November 29, 2025; and
WHEREAS, due to the need for additional design and coordination of utility infrastructure, the award said contract has been delayed; and
WHEREAS, the City wishes to submit a request to the NJDOT to extend this deadline to allow the City additional time to award the contract for construction of the Project, extending the deadline from November 29, 2025 through May 29, 2026.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby authorized to request from the State of New Jersey Department of Transportation {“NJDOT”) a deadline extension which would allow the City of Newark until May 29, 2026 to award a contract for construction of the Newark Transit Village Pedestrian Safety Improvement Project (“Project”).
2. The Mayor of the City of Newark and/or his designee, the Director of the Department of Engineering, are hereby further authorized to execute any document necessary to effectuate any extension accorded by NJDOT.
3. All other terms and conditions of the grant award from NJDOT for the FY 2024 Transit Village Grant Program for the construction of the project shall remain in force and effect until the contract is completed.
STATEMENT
This Resolution authorizes the Mayor of the City of Newark and/or his designee, Acting Director of the Department of Engineering, to request a time extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the Newark Transit Village Pedestrian Safety Improvement Project, thereby extending the deadline from November 29, 2025 through May 29, 2026. No Municipal funds are required.
