WHEREAS, Resolution 7R4B, adopted August 5, 2015, authorized the Director of the Department of Engineering to execute Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307, for a term of one (1) year from July 6, 2015 to July 5, 2016 with two (2) one (1) year options to extend; and
WHEREAS, the Director of the Department of Engineering believes that the above services are being performed in an effective and efficient manner and as a result, on April 18, 2017, the City of Newark exercised the option to extend the contract; and
WHEREAS, on April 20, 2017, EIC Inspection Agency Corporation accepted the option to extend Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, for an additional one (1) year period; and
WHEREAS, the Director of the Department of Engineering desires to amend Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, to extend the term of the contract one year, through July 5, 2017, at no cost to the City.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee and the Director of the Department Engineering, are hereby authorized to execute Amendment #1 to Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, with EIC Inspection Agency Corporation, 3705/3707 Kennedy Boulevard, Jersey City, New Jersey 07307, to extend the term of the contract for one year, through July 5, 2017, pursuant to N.J.S.A. 40A:11-15, because the services are being performed by EIC Agency Corporation in an effective and efficient manner and at no additional cost to the City.
2. The Amendment #1 to Contract #02-2015 is ratified from July 5, 2016 until the date of adoption of this resolution.
3. All other terms and conditions of Contract #02-2015 Third-Party Inspection Agency for Elevator Sub-Code Official Inspections and Plan Review Services, covered by N.J.A.C. 5:23-4.14, shall apply and remain in full force and effect.
4. No Certification of Funds is required for this contract since the funds to pay the private on-site inspection agency to serve as the on-site Elevator Sub-Code Official will be generated from the fees collected for elevator inspections. No fees need to be paid to the agency if an inspection does not take place, and no fees are generated.
5. No further amendments or modifications to this amended contract shall be permitted without prior Municipal Council approval.
6. A fully executed copy of this Amendment #1 shall be filed in the Office of the City Clerk by the Director of the Department of Engineering or his designee.
