WHEREAS, Resolution 7R12-o December 20, 2024, pursuant to a fair and open process, authorized the Director of Water and Sewer Utilities to execute a contract with Coastal Engineering LLC, 54 Davis Road, Franklin, New Jersey 07416, to provide professional engineering services on an As Needed Basis and for a contract amount not to exceed $150,000.00 and for a contract period from January 1, 2024 through December 31, 2024, and when applicable may extend beyond, as authorized by N.J.S.A. 40A:11-15(9) for the duration of the construction; and
WHEREAS, the Department of Water and Sewer Utilities requested and received a proposal dated October 11, 2024 to perform engineering services and conduct diving services for the Oak Ridge Dam Concrete Repair & Bulkhead Installation (Oakridge Dam project) in the amount of $224,304.00; and
WHEREAS, as of October 2024, Coastal Engineering has provided engineering services in an amount of $5,500.00; and
WHEREAS, an additional amount of $79,804.00 is needed above the currently available $144,500.00 in the contract, to cover the cost of the Oakridge Dam project; and
WHEREAS, the requested increase of $79,804.00 is deemed necessary and reasonable to cover the cost of the Oakridge Dam project.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, are authorized to execute amendment No.1 to the Agreement with Coastal Engineering LLC, 54 Davis Road, Franklin, New Jersey 07416, to provide Professional Engineering Services for an additional $79,804.00, for a total contract amount of $229,804.00.
2. All other terms and conditions of the contract remain the same.
3. The funds for this First Amendment to the Agreement to provide engineering services shall be paid from the City of Newark Budget/Department of Water and Sewer Utilities after the issuance of a Certification of funds from the Director of the Department of Finance, which states that funds in the amount of $79,804.00 are available in the department of Water and Sewer Utilities 2024 budget. The Certification of Funds shall be filed along with the original Resolution in the Office of the City Clerk.

4. The Director of the Department of Water and Sewer Utilities shall file a duly executed copy of the Amendment No. 1 to the Agreement in the Office of the City Clerk.
5. A notice of this action shall be published in the newspaper authorized by law to publish a legal advertisement and as required by law within ten (10) days of the adoption of this resolution.
STATEMENT
This Resolution amends and authorizes the Mayor and/or his designee, the Director of the Department of Water and Sewer Utilities, to execute Amendment No.1 to the contract for Professional Engineering Services on an As Needed Basis with Coastal Engineering LLC, 54 Davis Road, Franklin, New Jersey 07416, to increase the contract amount for an additional $79,804.00, for a total contract amount not to exceed of $229,804.00.
