WHEREAS, the City of Newark (the “City”) seeks to partner with emergency shelters that will provide temporary housing accommodations and supportive services to homeless Newark residents; and 

 

WHEREAS, pursuant to State Local Public Contracts Law, N.J.S.A. 40A:11-4.1(b)(2), the competitive contracting process may be used for the operation, management or administration of social service programs; and

 

WHEREAS, pursuant to the Fair and Open Process of State Pay-to-Play Law, N.J.S.A. 19:44A-20.5, the City publicly advertised a Request for Proposal (RFP) on or about January 13, 2026, for Emergency Housing Program For Individuals and Families with all such proposals due on February 10, 2026; and

 

WHEREAS, the Proposal received from Turning Point, 1011 Grove Street Irvington, New Jersey 07111 (hereinafter referred to as “Recipient”), was advantageous to the City based on experience and all other criteria listed in the RFP; and

 

WHEREAS, the Director of the Department of Health and Community Wellness, (“DHCW”),  Office of Homeless Services desires to enter into an Agreement with the Vendor, for the purpose of providing Emergency Housing Program for Newark Residents Individuals and Families services for the contract period April 1, 2026 through March 31, 2027, for a total not to exceed amount of Two Hundred Seventy Thousand One Hundred Dollars and Zero Cents ($270,100.00), with an initial performance period of April 1, 2026 through May 31, 2026, for a partial award of Forty-Five Thousand One Hundred Forty Dollars and Zero Cents ($45,140.00),  balance of the contract is subject to the availability of funds; and

 

WHEREAS, this Agreement is awarded to the Recipient, in compliance with Local Public Contracts Law, including but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Emergency Housing Program for Newark Residents Individuals and Families; and

 

WHEREAS, the Municipal Council of the City of Newark deems it to be in the best interest of the City to enter into a contract with the Recipient for the provision of emergency housing for the Emergency Housing Program for Newark Resident Individuals and Families.

 

NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

 

1.                     The Mayor and/or his designee, the Director of the Department of Health and Community Wellness, Office of Homeless Services, is hereby authorized to enter into and execute an Agreement with Turning Point,1011 Grove Street, Irvington New Jersey 07111 (hereinafter referred to as “Recipient”), for the period April 1, 2026 through March 31, 2027, for the contract period April 1, 2026 through March 31, 2027, for a total not to exceed amount of Two Hundred Seventy Thousand One Hundred Dollars and Zero Cents ($270,100.00), with an initial performance period of April 1, 2026 through May 31, 2026 for a partial award of Forty-Five Thousand One Hundred Forty Dollars and Zero Cents ($45,140.00), to provide Emergency Housing Program services, which are further described in the “Scope of Services” attached hereto and made a part of this Agreement.

 

2.                     The terms of this Agreement may only be waived or amended in writing and signed by the parties duly authorized to execute this Agreement, subject to the approval of the Newark Municipal Council by Resolution. The term of this Agreement may be extended for up to two (2) 6-month periods, provided that any such extension is at no additional cost to the City, is authorized by Resolution of the Newark Municipal Council including a finding that the services are being performed in an effective and efficient manner; and is in writing signed by both parties.

 

3.                     The Agreement between the City of Newark and the Recipient is hereby ratified from April 1, 2026 to the date of adoption of this authorizing Resolution.

 

4.                     Pursuant to N.J.A.C. 5:30-5.5, attached hereto is a partial Certification of Funds from the Director of Finance, which states that funds in the amount of Forty-Five Thousand One Hundred Forty Dollars and Zero Cents ($45,140.00), the compensation to be paid pursuant to said Agreement for the of an initial performance period of April, 1, 2026 through May 31, 2026 is partially certified from budget codes 011-200-2001-A-97550-B2026. The remaining total not to exceed amount for the Contract is subject to the availability of funds to be paid from unclassified funding.

 

5.                     The Municipal Council ratifies the use of competitive contracting for processing and awarding Housing and Urban Development Entitlement Programs from April 1, 2026 to the date of adoption of this Resolution and authorizes its use in the future.

 

6.                     This Agreement is being awarded pursuant to the fair and open procedures of the State Pay-to-Play Law, N.J.S.A 19:44A-20.5, State Local Public Contracts Law, including, but not limited to N.J.S.A. 40A:11-4.1(b)(2) and/or N.J.S.A. 40A:11-5, and Emergency Housing Program for Newark Residents Individuals and Families.

 

7.  An executed copy of said Agreement, and a copy of the Partial Certification of Funds along with a Certified copy of this Resolution shall be filed with the Office of the City Clerk by the Director of the Department of Health and Community Wellness, Office of Homeless Services.

 

STATEMENT

 

                     This Resolution ratifies and authorizes the Mayor and/or his designee, and  the Director of the Department of Health and Community Wellness, Office of Homeless services, to enter into an Agreement with Turning Point, 1011 Grove Street, Irvington, New Jersey 07111 , for the period of  April 1, 2026 through March 31, 2027, for a total not to exceed amount of Two Hundred Seventy Thousand One Hundred Dollars and Zero Cents ($270,100.00), with an initial performance period of April, 1, 2026 through May 31, 2026, for an amount of Forty-Five Thousand One Hundred Forty Dollars and Zero Cents ($45,140.00) to provide Emergency Housing Program services to Newark Residents. The remaining amount of the Contract is subject to the availability of funds.
