AN ORDINANCE AMENDING AND SUPPLEMENTING, TITLE XIII, FOOD, DRUGS AND COSMETICS, CHAPTER 4, MILK PRODUCTS, ARTICLE 7, ICE CREAM PEDDLERS OF THE REVISED GENERAL ORDINANCES OF THE CITY OF NEWARK, NEW JERSEY, 2000, AS AMENDED AND SUPPLEMENTED TO AMEND CERTAIN FEES AND LIMIT THE NUMBER OF LICENSES ISSUED.

WHEREAS, the City of Newark issues numerous licenses, including for ice cream and specialty drinks (“pina colada”) peddlers; and
WHEREAS, the City of Newark has determined that it is necessary to adjust fees for the aforementioned licensees and impose a restriction on the number of certain licenses; and
WHEREAS, the Municipal Council finds and declares the following amendments to the Revised General Ordinances of the City of Newark, New Jersey, 2000, as amended and supplemented, are deemed necessary for the preservation of the public peace, health, and/or safety within the City of Newark.
NOW, THEREFORE, BE IT ORDAINED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:

SECTION 1. Title XIII, Food, Drugs and Cosmetics, Chapter 4, Milk Products, Article 7, Ice Cream Peddlers, of the Revised General Ordinances of the City of Newark, New Jersey, 2000, is hereby amended as follows:
§ 13:4-71 LICENSE FEES.

The license fee to be imposed under this Article for each year shall be $1500.00 $150.00 for each wagon, pushcart, automobile, bicycle or other vehicle or receptacle from which ice cream, ices and flavored ice water are sold. The license fee to be imposed under this Article for each year shall be $1,500.00 for each automobile, motorized vehicle, wagon or other vehicle from which specialty drinks, such as pina coladas, the ice cream, ices and flavored ice water are sold. There shall be no more than ten (10) such licenses issued City-wide to distribute or sell the ice cream, ices and flavored ice water. There shall be no more than ten (10) such licenses issued City-wide to distribute or sell specialty drinks, such as pina coladas. For each salesperson, in addition to the above license fees, there shall be a fee of $10. No one license can be used for multiple automobiles, vehicles, motorized vehicles or wagons. The $1500 $1,500.00 license fee shall not apply to the non-motorized pushcarts which sell the ice cream, ices and flavored ice water; the fee for those non-motorized pushcarts shall be $150.00 for each.
Section 2. If any provision of this Ordinance is held to be unenforceable by a Court of competent jurisdiction, the remainder shall remain in full force and effect.
Section 3. This Ordinance shall take effect upon final passage and publication in accordance with the law of the State of New Jersey.

An Ordinance amending Title XIII, Food, Drugs and Cosmetics, Chapter 4, Milk Products, Ice Cream, Article 7, Ice Cream Peddlers of the Revised General Ordinances of the City of Newark, New Jersey, 2000, to amend certain fees and limit the number of licenses to be issued.
