WHEREAS, an emergency has arisen in Special Item of Appropriation in the amount of $5,789,337.00 for the HOPWA Program and no adequate provision has been made in the 2021 Temporary Budget for the aforesaid purpose and N.J.S.A. 40A: 4-20 provides for the creation of an emergency appropriation for the purpose above-mentioned; and
WHEREAS, by the award letter dated March 25, 2021, the U.S. Department of Housing and Urban Development (HUD) has awarded the City of Newark the HOPWA Grant in the amount of $5,789,337.00. The aforementioned program focus is to provide housing assistance and related supportive services for low-income persons living with HIV/AIDS and their families within the City of Newark; and
WHEREAS, the Department of Administration will be submitting a separate companion Apply and Accept Resolution to the Municipal Council for its review and consideration relative to said grant award; and
WHEREAS, a previous resolution authorizing TE # 22 and prior emergency appropriations submitted for Municipal Council approval totaled $149,548,353.36; and
WHEREAS, N.J.S.A. 40A: 4-20 provides that the Governing Body by a two-thirds vote may make temporary emergency appropriations for any purpose for which appropriations may lawfully be made for the period between the beginning of the current fiscal year and the date of the adoption of the budget for said year; and
WHEREAS, emergency appropriations adopted in 2021, pursuant to N.J.S.A. 40A: 4-20 including this resolution total…………………$155,337,690.36.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
No less than two-thirds of all members thereof affirmatively concurring.
1. A temporary emergency appropriation be and the same is
hereby made for the following classification.
Program Amount
HOPWA Program $5,789,337.00
2. Said emergency appropriation shall be provided for in the 2021 budget.
3. A copy of this resolution shall be filed with the Director of Local Government Services by the City Clerk of the City of Newark.
STATEMENT
This Resolution authorizes and establishes the temporary emergency appropriation for the HOPWA Program in the amount of $5,789,337.00. The U.S. Department of Housing and Urban Development (HUD) are awarding said funds to the City of Newark. The project period is September 1, 2020 through August 31, 2021. (Citywide).
