Resolution #7R3-a adopted on September 5, 2024. This Resolution authorizes the Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, to request a time extension from NJDOT to allow the City of Newark additional time to award a contract for construction of the LA-2023 TV Newark City Newark Morris Canal Bikeway project, thereby extending the deadline from June 12, 2025 to December 12, 2025. No municipal funds are required

WHEREAS, the State of New Jersey Department of Transportation (NJDOT) FY-2023 Transit Village Grant Program for LA-2023 TV provides municipalities with grant funding for bicycle lane projects; and
WHEREAS, on July 1, 2022, the Acting Director of the Department of Engineering, on behalf of the City of Newark (the “City”), submitted an application to NJDOT requesting grant funding from the NJDOT FY-2023 Transit Village Grant Program for construction of the Newark Morris Canal Bikeway Project, identified as LA-2023 TV Newark City Newark Morris Canal Bikeway (the “Project”); and
WHEREAS, on August 3, 2022, the Municipal Council adopted Resolution 7R3-b ratifying and authorizing the Acting Director of the Department of Engineering to apply for, accept, and execute grant documents for a grant award from the NJDOT FY-2023 Transit Village Grant Program for construction of the Project; and
WHEREAS, on December 12, 2022, NJDOT announced that the City was selected to receive a grant award in the amount of Four Hundred Seventy Thousand Dollars and Zero Cents ($470,000.00) for the construction of the Project; and
WHEREAS, NJDOT requires the City to award the contract for construction of the Project within two (2) years of the grant award notification, with a deadline of December 11, 2024; and
WHEREAS, on August 20, 2024, due to the need for additional design and coordination of utility infrastructure, the award has been delayed; and
the City filed for an extension of the deadline from December 11, 2024 to June 12, 2025; and
WHEREAS, on September 05, 2024, the Municipal Council adopted Resolution 7R3-a authorizing the extension request from NJDOT from December 11, 2024 through June 12, 2025; and
WHEREAS, on October 31, 2024, NJDOT granted an extension to award the contract for construction of the Project with a deadline of June 12, 2025; and
WHEREAS, the City wishes to submit a second request to NJDOT to allow the City of Newark additional time to award the contract for construction of the Bikeway Program for the LA-23 TV Newark Morris Canal Bikeway, extending the deadline from June 12, 2025 to December 12, 2025.
NOW, THEREFORE, BE IT RESOLVED BY THE MUNICIPAL COUNCIL OF THE CITY OF NEWARK, NEW JERSEY, THAT:
1. The Mayor of the City of Newark and/or his designee, the Acting Director of the Department of Engineering, are hereby authorized to request a time extension from the NJDOT to allow the City of Newark additional time to award a contract for construction of LA-2023 TV Newark City Newark Morris Canal Bikeway project by December 12, 2025.
2. All other terms and conditions of the grant award from the NJDOT for the FY-2023 Transit Village Program for LA-2023 TV Newark City Newark Morris Canal Bikeway project shall remain in force and effect until the contract is completed.
